OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING A PROFESSIONAL SERVICES AGREEMENT
WITH ENGINEERING PROFESSIONALS, INC.
WHEREAS, Engineering Professionals has satisfactorily completed the
conceptual , preliminary and final design for the Spring Creek Drainage
Basin; and
WHEREAS, The Storm Water Utility's best professional advice states
that additional liability and field problems would result from hiring a
different professional firm for construction management services; and
WHEREAS, funds have been budgeted and appropriated in the Storm
Drainage budget for 1989 for the acquisition of the abovementioned
services; and
WHEREAS, §8-123(a) (1) of the Code of the City of Fort Collins
authorizes the Purchasing Agent to negotiate the purchase of supplies and
services without utilizing a competitive bidding process where such process
does not appear to be practical , based on limited availability which would
result in substantially higher costs to the City; and
WHEREAS, the Purchasing Agent has determined that this purchase is
within the purview of this exception to the competitive bidding
requirements of the City Code and Charter, has performed the necessary
search required by the Code and has submitted the requisite justification
to the City Manager for approval ; and
WHEREAS, the City Manager has reviewed and approved the justification
for this acquisition; and
WHEREAS, §8-123 requires approval of this purchasing method by the
City Council for items costing more than Twenty Thousand Dollars ($20,000)
prior to acquisition.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the contract with Engineering Professionals for construction
management services in the amount of Sixty-four Thousand Dollars (E64,0OO)
is hereby approved.
Passed and adopted at a regular meeting of the City Council held this
7th day of November, A.D. , 1989.
