OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE AIRPORT MANAGER TO EXECUTE A
LEASE AGREEMENT
AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT
WITH THE STATE OF COLORADO
WHEREAS, the Cities of Fort Collins and Loveland (the "Cities") jointly own and operate
the Fort Collins-Loveland Municipal Airport (the "Airport"), including the Terminal located on said
Airport; and
WHEREAS, pursuant to Section 23-114(a) of the Code of the City of Fort Collins (the
"Code"), the Council is authorized to lease any and all interests in real property owned in the name
of the City, provided that Council first finds that the lease is in the best interests of the City; and
WHEREAS, Section 23-114(b) of the Code defines a lease as a contract by which the City
grants to another the right to possess, use and enjoy any real property owned by the City for ten (10)
days or longer, in exchange for the payment of rent in a stipulated amount; and
WHEREAS, the Intergovernmental Agreement for the Joint Operation of the Fort Collins-
Loveland Municipal Airport between the Cities specifically recognizes the leasing of Airport
Property as a valid use of the jointly owned Airport Property; and
WHEREAS, the State of Colorado, Board of Governors of the Colorado State University
System, acting by and through Colorado State University, has indicated a desire to enter into a short
term lease agreement that would allow it the use of a portion of the Terminal, consisting of an
office of approximately 144 square feet and a portion of the Terminal parking lot, for a period of
approximately 3 months, in order to maintain an office to support its forest fire air tanker program.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That it is in the best interests of the City to execute a short term lease
agreement with the State of Colorado pursuant to the terms of the Lease Agreement, a copy of
which is on file in the Office of the City Clerk, for that portion of the Airport premises described
therein.
Section 2. That the Airport Manager is hereby authorized to execute said Lease
Agreement, subject to such modifications in form or substance as the Airport Manager, in
consultation with the City Attorney, may deem necessary to effectuate the purposes of this
Resolution or to protect the interests of the City.
