OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO ENTER INTO A FARM LEASE
AGREEMENT WITH GREG S. WALKER
WHEREAS, on June 5, 1990, the Council of the City of Fort Collins adopted
Resolution 90-74 authorizing the purchase of land for a proposed future regional
wastewater treatment plant; and
WHEREAS, as a part of that purchase, the City accepted an assignment of
a farm lease executed by the Seller and Greg S. Walker, which Lease expired on
December 31, 1990; and
WHEREAS, the City has received an offer from Mr. Walker to lease
approximately 73 acres of said land from the City for a term of 2 years at an
annual lease rate of $4100 (plus or minus annual year-end rent adjustments based
on the Chicago Board of Trade price of corn on December 1st) ; and
WHEREAS, Craig Harrison, holder of the right of first refusal pertaining
to this lease offer, has elected not to exercise said right of first refusal ;
and
WHEREAS, Section 23-114 of the City Code authorizes the Council to lease,
for a definite term of two (2) years or less, any and all interests in real
property owned in the name of the City, provided that the Council first finds
by resolution that the lease is in the best interests of the City.
NOW, THEREFORE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that:
Section 1 . The City Council finds that it would be in the best interests
of the City to execute a Lease Agreement with Greg S. Walker, with a lease term
of two (2) years and at an annual lease rate of Four Thousand One Hundred Dollars
($4, 100) (as adjusted) for approximately seventy-three (73) acres of land owned
by the City and located at the site of the proposed future regional Wastewater
Treatment Plant in the SW Quarter of Section 13, Township 6 North, Range 68 West
of the 6th P.M. in Larimer County.
Section 2. That the Mayor be, and hereby is, authorized to execute the
Lease Agreement with Greg S. Walker, as described in Section 1 of this
Resolution, for a term of two (2) years and at an annual lease rate of Four
Thousand One Hundred Dollars ($4, 100) (plus or minus annual year-end rent
adjustments based on the Chicago Board of Trade price of corn on December 1st) .
Passed and adopted at a regular meting of the Council of the City of Fort
Collins held this 19th day of March, A.D. 1991 .
