HomeMy WebLinkAbout1991-098-07/02/1991-RESOLUTION 91-71 SALE SOUTHRIDGE GOLF COURSE RESOLUTION 91-98 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING RESOLUTION 91-71 AND PROVIDING ADDITIONAL DIRECTION TO CITY STAFF WITH REGARD TO THE SALE OF SOUTHRIDGE GOLF COURSE WHEREAS, on May 7, 1991, the Council of the City of Fort Collins ("the Council ") adopted Resolution 91-71 ; and WHEREAS, Resolution 91-71 directed City staff to repackage and market the sale of the SouthRidge Golf Course ("the Course") ; and WHEREAS, Resolution 91-71 directed City staff to market the sale of the Course by calling for sealed proposals from potential purchasers to be opened on October 1, 1991, with any transaction to sell the Course to occur no later than February 29, 1992, and if the Course is not sold by February 29, 1992, that the issue of the sale of the Course be brought back to Council for its further consideration; and WHEREAS, City staff is now recommending that a more effective method of marketing the sale of the Course is to eliminate the procedure of calling for sealed proposals and to instead acquire the services of real estate brokers experienced in the sale of golf courses by entering into nonexclusive real estate listing agreements with as many experienced real estate brokers as meet the minimum requirements and specifications set by the City through its applicable procedures under the City Code for procuring professional services; and WHEREAS, City staff recommends that the nonexclusive listing agreements entered into with the qualifying real estate brokers provide for a real estate commission of eight percent (8%) of the gross sales price of the Course and that the minimum net sales price of the Course. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. The Council finds that it is in the best interests of the City for the City to eliminate the procedure of calling for sealed proposals and to instead acquire the services of experienced real estate brokers for the sale of the Course. Section 2. That City staff is hereby directed to procure the services of experienced and qualified real estate brokers to market the sale of the Course by entering into nonexclusive listing agreements with such brokers, upon such terms and conditions as the City Manager considers to be in the best interests of the City, provided, however, that the listing agreements shall provide: (a) for a real estate commission of not more than eight percent (8%) of the gross sales price of the Course; and (b) that payment of the real estate commission under the listing agreement shall be contingent upon the Council 's adoption of an ordinance approving the proposed sale of the Course and the subsequent closing of that transaction. Section 3. That any transaction to sell the Course shall occur no later than February 29, 1992, and if the Course is not sold by February 29, 1992, that the issue of the sale of the Course shall be brought back to the Council for its further consideration.
