HomeMy WebLinkAbout1991-073-05/07/1991-BURNING CEMENT KILNS HAZARDOUS WASTE RESOLUTION 91-73 OF THE COUNCIL OF THE CITY OF FORT COLLINS CONCERNING THE BURNING OF HAZARDOUS WASTE IN CEMENT KILNS IN THE VICINITY OF THE CITY OF FORT COLLINS WHEREAS, the disposal of hazardous waste materials is sometimes accomplished by the burning of such waste in cement kilns, boilers and industrial furnaces, whether for energy recovery purposes or otherwise; and WHEREAS, Holnam, Inc. recently presented a general proposal to burn hazardous waste in the Boettcher Plant Cement Kiln (the "Proposal ") ; and WHEREAS, the burning of hazardous waste in cement kilns can adversely affect public health and the environment through the routine or accidental release of hazardous waste during transportation, transfer or storage and through the burning process itself; and WHEREAS, the primary authority for the management and regulation of toxic and hazardous substances rests with the United States Environmental Protection Agency, the Colorado Department of Health and Larimer County; and WHEREAS, the Council desires to work cooperatively with the United States Environmental Protection Agency, the Colorado Department of Health and Larimer County on matters of environmental concern; and WHEREAS, the Council has determined that pollution prevention (reduction of hazardous waste generation through a variety of currently available techniques) is preferred over burning as a waste management strategy and that pollution prevention should be encouraged by government policy; and WHEREAS, the operation of cement kilns as hazardous waste incinerators is expected to reduce the disposal cost for such wastes, with the corresponding result that hazardous waste generators will be less inclined to investigate and adopt pollution prevention techniques; and WHEREAS, pursuant to Resolution 91-25, the Council stated its belief that hazardous or toxic substances should not be burned as fuel in cement kilns; and WHEREAS, the Council has determined that a thorough and comprehensive regulatory review process has not yet been adopted by the State of Colorado; and WHEREAS, the Council has further determined that effective enforcement and monitoring programs have not yet been implemented at either the State or federal level in such a manner as to adequately protect the citizens of the City; and WHEREAS, sufficient data or information has not been developed to show that the environment in the Fort Collins area would not be adversely affected by the transportation, transfer, storage and burning of hazardous wastes in cement kilns in the vicinity of the City of Fort Collins; and WHEREAS, the citizens of the City have expressed considerable concern about the environmental impacts on the City of burning hazardous wastes in the Fort Collins vicinity; and WHEREAS, the Council has determined that it is in the best interest of the citizens of the City that the Council remain opposed to the burning of hazardous waste in cement kilns in the vicinity of the City of Fort Collins. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council of the City of Fort Collins remains opposed to the Proposal and to any such burning of hazardous waste in cement kilns in the vicinity of the City of Fort Collins. Section 2. That City staff is hereby directed to develop for Council 's review and approval a proposed workplan to implement the foregoing policy of opposition, including development of a policy that City-funded projects will not use cement made from cement kilns that burn hazardous waste as a fuel .
