OF THE COUNCIL OF THE CITY OF FORT COLLINS
ENDORSING THE COLORADO WATER CONSERVATION BOARD'S
ACQUISITION OF WATER RIGHTS IN THE CACHE LA POUDRE
RIVER FOR THE PURPOSE OF PRESERVING THE ENVIRONMENT
WHEREAS, in accordance with the Constitution of the State of Colorado,
the right to divert the unappropriated water of any natural stream to
be
neficial uses shall never be denied; and
WHEREAS, in accordance with the laws of the State of Colorado,
"beneficial use" shall also include the appropriation by the State of
Colorado of such minimum flows between specific points or levels for and on
natural streams and lakes as are required to preserve the natural
environment to a reasonable degree; and
WHEREAS, the Colorado Water Conservation Board is authorized, on behalf
of the people of the State of Colorado, to acquire water rights in streams
and lakes for the reasonable preservation of the natural environment; and
WHEREAS, the Colorado Water Conservation Board is considering acquiring
water rights in the Cache La Poudre River for the purpose of preserving the
natural environment; and
WHEREAS, the Fort Collins Water Board and the Fort Collins Natural
Resources Advisory Board have reviewed the proposed acquisition of water
rights by the Colorado Water Conservation Board; and
WHEREAS, it is the finding of the Fort Collins Water Board and the Fort
Collins Natural Resources Advisory Board that the acquisition of water
rights by the Colorado Water Conservation Board would not substantially
impact the City's present water supply and would enhance the natural
environment of the Cache La Poudre River; and
WHEREAS, the Fort Collins Water Board and the Fort Collins Natural
Resources Advisory Board recommends that the City Council endorse the
Colorado Water Conservation Board's efforts to acquire water rights in the
Cache La Poudre River for the purpose of preserving the natural environment.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the City Council endorses the Colorado Water Conservation
Board's efforts to acquire water rights in the Cache La Poudre River for the
purpose of preserving the natural environment of the river.
Passed and adopted at a regular meeting of the City Council held this
5th day of November, A.D. 1985.
