HomeMy WebLinkAbout1985-204-11/05/1985-MAKING FINDINGS RELATING TO THE APPEAL OF THE DECISION OF THE FIRE BOARD OF APPEALS CONCERNING INDOO RESOLUTION 85-204 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS RELATING TO THE APPEAL OF THE DECISION OF THE FIRE BOARD OF APPEALS CONCERNING INDOOR FIREWORKS DISPLAYS WHEREAS, on July 30, 1985, the Poudre Fire Authority denied a request for a permit for indoor fireworks displays by representatives of Fort Ram, a local nightclub; and WHEREAS, the decision of the Poudre Fire Authority was appealed to the Fire Board of Appeals by representatives of Fort Ram; and WHEREAS, on August 6, 1985, the Fire Board of Appeals met and considered the reasons for denial of the permit request and Fort Ram' s arguments for reversal of that decision and, after hearing the evidence, voted to reverse the decision of the Poudre Fire Authority and directed staff to promulgate regulations for the indoor fireworks displays and issue a permit based upon such regulations; and WHEREAS, the decision of the Fire Board of Appeals was appealed to the City Council by the Administrative Chief of the Poudre Fire Authority; and WHEREAS, the City Council met on October 15, 1985, considered the appeal relating to the permit request for indoor fireworks displays and voted to reverse the decision of the Fire Board of Appeals and support the Poudre Fire Authority' s original denial of the permit for such displays. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: 1. The displays proposed by representatives of Fort Ram do constitute "fireworks" as defined in the Uniform Fire Code, 1982 Edition, which has been adopted by the City of Fort Collins. 2. Such displays in a nightclub environment, in particular, would pose a substantial threat to the safety of persons and property. 3. Due to the occupancy load of Fort Ram, the proposed frequency of the displays, the nature of the occupancy and the potential risk of damage or injury, it is not possible to develop regulations for such displays which, if followed, would render them safe. 4. Such displays present a potential health hazard to employees and guests of the establishment. 5. The decision of the Fire Board of Appeals to reverse the decision of the Poudre Fire Authority is hereby reversed and the denial of the permit request by the Poudre Fire Authority is hereby sustained, Passed and adopted at a regular meeting of the City Council held this 5th day of November, A.D. 1985. �Ns 2 Ml yor ATTEST: City
