HomeMy WebLinkAbout1985-211-11/05/1985-ACCEPTING A PETITION OF A PROPERTY OWNER REGARDING THE INITIATION OF GREENBRIAR SPECIAL IMPROVEMENT RESOLUTION 85- 211 OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING A PETITION OF A PROPERTY OWNER REGARDING THE INITIATION OF THE GREENBRIAR SPECIAL IMPROVEMENT DISTRICT, STATING THE NEED FOR, THE NATURE OF, AND THE LOCATION OF THE IMPROVEMENTS TO BE MADE, DESCRIBING THE AREA TO BE ASSESSED FOR THE SAME, AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND PRESENT TO THE CITY COUNCIL THE NECESSARY INFORMATION FOR THE FORMATION OF SAID DISTRICT. WHEREAS, the Citv Council has received a petition from The First Interstate Bank of Fort Collins , N.A. , ( the "Petitioner" ) , sole property owner in the proposed Greenbriar Special Improvement District ( the "District" ) for the creation of a special improvement district for the purpose of installing certain public improvements in the City; and WHEREAS, the City Council has received the petition, accepts the same , and desires to proceed with the formation of the District. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1 . That the Petition as submitted by the Petitioner requesting the formation of the District is hereby received and accepted. Section 2. That the improvements to be constructed consist of street, curb and gutter, sidewalk, street lighting, water line, sanitary sewer line, storm drainage and landscaping improvements (hereinafter collectively referred to as the " Improvements" ) . Such Improvements are needed in order to provide adequate access for vehicles and pedestrians to the properties abutting the streets to be improved, and in order to provide utility service to properties within the District . Section 3. That it is hereby recognized that the Improvements will confer special benefits on the real property in the District and general benefits to the City at large. Section 4. That the nature and location of the Improvements to be made in the District are as set forth on Exhibit "A" attached hereto and by this reference incorporated herein. Section 5. That the Director of Public Works is hereby directed to prepare and present to the Council the following: 5. 1 Preliminary plans and specifications of the Improvements proposed. 5 .2 An estimate of the total cost of such Improvements , including the cost of constructing the same , planning, engineering, legal and advertising costs, interest during construction and until assessments are made by ordinance acainst the properties benefited, and other incidental costs. 5 .3 A map of the District to be assessed for the cost of the Improvements. Section 6. That the area to be assessed for the Improvements shall be as set forth in the Petition heretofore submitted by Petitioner. Section 7. That said improvement District shall be known as the Greenbriar Special Improvement District No. 87. Passed and adopted at a reqular meeting of the City Council held this 5th day of November 1985. Improvements to that portion of LEMAY AVENUE located adjacent to the eastern boundary of the Replat of Greenbriar Subdivision , City of Fort Collins, Larimer County, Colorado ( "Greenbriar" ) as follows: a. 1124 lineal feet of pavement, 35 feet in width from flow line to flow line, together with verticle curb and gutter and sidewalk running along the Western boundary of said street; b. 524 lineal feet of existing 24 inch ductal iron pipe ( "D. I.P." ) water line and 600 lineal feet of new 12" D. I.P. water line; C . 1124 lineal feet of 2 1/2 inch thick asphalt overlay, 12 feet in width , on the existing northbound lane of said street; d . Landscaping and fencing adjacent to Lemay Avenue in accordance with the Landscape Plan for Greenbriar filed with and approved by the City and incorporated herein by reference ( the "Landscape Plan" ) . 2 . Improvements to that portion of KILL.OX LANE from its intersection with Lemay Avenue to its intersection with Redwood Street as follows : a. 3220 lineal feet of pavement , 48 feet in width from flow line to flow line, together with existing drive over curb, gutter and sidewalk and new vertical curb and gutter; b . 3220 lineal feet of existing 24 inch D. I .P water line; C. 180 lineal feet of existing 8 inch sanitary sewer line , 170 lineal feet of new 8 inch sanitary sewer line and three manholes; d . 140 lineal feet of 24 inch existinq storm drainage pipe, 220 lineal feet of existing 18 inch storm drainage pipe, 413 lineal feet of existing storm drainaqe pipe, three existing manholes , and three existing storm drainaqe inlets; e . Landscaping and fencing adjacent to Willox Lane in accordance with the Landscape Plan . 3 . Improvements to GROUSE CIRCLE from its intersection with Willox Lane to its intersection with Park Site as follows : a. 1090 lineal feet of pavement, 36 feet in width from flow line to flow line, toqether with new drive over curb, gutter and sidewalk on both sides of said street; b . 882 lineal feet of existinq and new 8 inch sanitary sewer line , five manholes , and 28 four inch service lines; C . 1090 lineal feet of existinq and new 6 inch water line , two fire hydrants, and 28 three-quarter inch service lines; d . 36 lineal feet of 15 inch storm drainage pipe toqether with two inlets. e . Primary power distribution lines and appurtenances for street lighting on said street and provide electric service to 28 lots in Greenbriar. 4 . Improvements to PICA RUN located on the North side of Willox Lane as follows : a . 280 lineal feet of pavement, 28 feet in width from flow line to flow line , together with existing drive over curb, gutter and sidewalk on the north side of said street and curb only on the south side of such street; b. 310 lineal feet of 8 inch existinq and new sanitary sewer line together with two manholes and 6 four inch service lines; C . 310 lineal feet of 6 inch existinq water line and 6 three-quarter inch service lines; d . Primary power distribution lines and appurtenances for street lighting on said street and to provide electric 2 service to six lots in Greenbriar; e . Landscaped island adjacent to the south side of said street . 5 . Improvements to PTARMIGAN COURT, a cul-de-sac located in the southeasterly portion of Greenbriar as follows : a. 249 lineal feet of pavement, 32 feet in width from flow line to flow line , together with existing drive over curb, gutter and sidewalk along the northeast side of said street and curb only on the southwest side of such street; b . 260 lineal feet of existing 8 inch sanitary sewer line, one manhole, and nine existing four inch service lines; C . 260 lineal feet of existing 6 inch water line and nine existing three-quarter inch water service lines; d . Primary power distribution lines for street lighting on said street and to provide electric service to nine lots in Greenbriar . 6 . Improvements to QUAIL RUN located on the South side of Willox Lane between its intersection with Shortleaf Street and its intersection with Ptarmigan Court as follows : a. 443 lineal feet of pavement , 28 feet in width from flow line to flow line, together with existing drive over curb, gutter and sidewalk on the south side of said street and existing curb only on the north side of such street; b . 820 lineal feet of existing 12 inch and 8 inch sanitary sewer lines in the rear of the lets adjacent to said street together with 5 manholes and ten four inch service lines; C . 480 lineal feet of existinq 6 inch water line and ten existinq three-quarter inch water service lines; d . Primary power distribution lines for street lighting on said streets and to provide electric service to ten lots in Greenbriar. e . Landscaped island located on the south side of said street. 3 t 7. Improvements to PEREGRINE RUN located on the south side of Willox Lane and west of Shortleaf Street as follows : a . 356 lineal feet of pavement, 28 feet in width from flow line to flow line, together with existinq drive over curb, gutter and sidewalk on the souther side of said street and curb only on the norther side of such street; b . 870 lineal feet of existing 8 inch and 12 inch sanitary sewer line , 2 manholes, and 8 four inch service lines; C. 340 lineal feet of existing 6 inch water line and 8 three-quarter inch service lines; d . Primary power distribution lines for street lightinq on said street and to provide electric service to eight lots in Greenbriar; e . Landscaped island located on the north side of said street. 8 . Improvements to SHORTLEAF STREET located on the south side of Greenbriar and running from the south boundary line of Green- briar to its intersection with Willox Lane as follows : a. 160 lineal feet of pavement, 40 feet in width from flow line to flow line , toqether with existing drive over curb, gutter and sidewalk on both sides of said street; b . 160 lineal feet of 6 inch water line. 9. Improvements to BRAMBLEBUSH STREET located on the north and west side of the adjacent City-owned park as follows : a. 1850 lineal feet of pavement , 36 feet in width from flowline to flowline, together with drive over curb, gutter and sidewalk on both sides of said street; b. 1780 lineal feet of 8 inch sanitary sewer line, 7 manholes , and 26 four inch service lines; C . 2000 lineal feet of 6 inch water line, four fire hydrants, 3 one and one-half inch water service lines and 22 three-quarter inch water service lines. 4 i d . Primary power distribution lines for street lighting on said street and to provide electric service to 23 lots in Greenbriar. 10. Improvements to BRIARCLIFF ROAD located on the east side of the adjacent City-owned park as follows: a . 480 lineal feet of pavement , 36 feet in width from flow line to flow line , together with drive over curb, gutter and sidewalk of both sides of said street; b . 370 lineal feet of 8 inch sanitary sewer line, 2 manholes , and 6 four inchservice lines; C . 360 lineal feet of 6 inch water line and 6 three-auarter inch service lines; d . Primary power distribution lines for street lighting on said street to provide electric service to seven lots in Greenbriar . A more detailed description of the Improvements is set forth in the Engineerina Report for the District filed with the City Clerk and incorporated herein h_y reference . 5
