OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT
WITH THE UNION PACIFIC RAILROAD COMPANY
PERTAINING TO A CONCRETE DRAINAGE PIPE LINE
ON THE RAILROAD'S RIGHT-OF-WAY
WHEREAS, the City of Fort Collins has annexed land into the City which
includes a concrete drainage pipe line in the right-of-way of the Union
Pacific Railroad; and
WHEREAS, Larimer County had executed an agreement with the Union
Pacific Railroad pertaining to this concrete drainage pipe line; and
WHEREAS, since the land containing the pipe line has been annexed into
the City, the agreement executed between the County and the Railroad needs
to be assigned to the City; and
WHEREAS, the Union Pacific Railroad Company has tendered to the City,
an agreement covering concrete drainage pipe line, with culvert on the
right-of-way of the Railroad Company at Fort Collins, Colorado; such
agreement being identified in the records of the Railroad Company as its
C.D. No. 50973; and
WHEREAS, the Council has given said proposed agreement careful
consideration; and
WHEREAS, it is considered that the best interests of the City will be
subserved by the acceptance of said agreement.
NOW, THEREFORE , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor and City Clerk be, and they hereby are, authorized,
empowered and directed to execute, and attest , an agreement, identified as
C.D. No. 50973, with the Union Pacific Railroad Company for a concrete
drainage pipe line with culvert on the right-of-way of the Railroad Company
at Fort Collins.
Passed and adopted at a regular meeting of the City Council held this
19th day of November, A.D. 1985.
