OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING FINDINGS RELATING TO THE APPEAL OF
LARIMER COUNTY ALCOHOL SERVICES
FOR USE OF 1415 SOUTH COLLEGE AVENUE
WHEREAS, on the 24th day of September, 1985, staff of the Community
Development Department administratively denied the proposed use by Larimer
County Alcohol Services of the structure located at 1415 South College
Avenue because of its interpretation of certain conditions of record
appearing on the approved planned unit development for that location; and
WHEREAS, that decision of staff was appealed by the applicant to the
Zoning Board of Appeals; and
WHEREAS, the Zoning Board of Appeals met on the loth day of October,
1985, considered the appeal on the Larimer County Alcohol Services from the
above-mentioned administrative decision and voted to uphold the
administrative decision; and
WHEREAS, the decision of the Zoning Board of Appeals was appealed by
the applicant to the City Council ; and
WHEREAS, the City Council met on the 5th day of November, 1985,
considered the appeal taken by the Larimer County Alcohol Services and
voted to uphold the decision of the Zoning Board of Appeals.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS AS FOLLOWS:
1. The proposed use of the structure at 1415 South College
Avenue by Larimer County Alcohol Services does not meet the
conditions placed on the property by the Planning and Zoning
Board at the time of approval of the 1415 & 1417 South
College Commercial PUD.
2. In particular, the proposed use of the structure by Larimer
County Alcohol Services does not conform to the trip
generation requirements of Condition p3 of the approved PUD.
3. The decision of the Zoning Board of Appeals to uphold denial
of the proposed Larimer County Alcohol Services use of 1415
South College Avenue is hereby sustained and said proposed
use is denied.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 19th day of November,
