OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPOINTING ARBITRATORS TO THE COLLECTIVE
BARGAINING PANEL PURSUANT TO
SECTION 2-624 OF THE CITY CODE
WHEREAS, at the August 10, 2004 Special Municipal Election, Citizen-Initiated Ordinance
No.1, 2004, was adopted by the electorate of Fort Collins; and
WHEREAS, said Ordinance amended Chapter 2 of the City Code by establishing a
collective bargaining process for certain employees in Police Services; and
WHEREAS, Section 2-623 of the City Code provides that unresolved issues concerning
mandatory subjects of bargaining between the City and the bargaining agent shall be submitted to
binding arbitration; and
WHEREAS, Section 2-624 of the City Code provides that the City Council shall create a
permanent panel of at least five (5) arbitrators from those qualified persons who apply so that the
panel will be available to draw from in the event that the City and the bargaining agent are unable
to reach agreement on a contract.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, COLORADO, as follows:
Section 1. The City Council finds that the below listed persons have applied for and are
qualified to serve as arbitrators pursuant to the criteria set forth at section 2-624(b) of the City
Code.
Section 2. That the following persons are hereby appointed to the panel of arbitrators
pursuant to the provisions set forth in Section 2-624(c) of the City Code for the terms indicated:
Norman Brand Six years
Benjamin L. Craig Six years
John P. DiFalco Four years
Thomas F. Levak Four years
Harry N. MacLean Two years
Daniel M. Winograd Two years
Section 3. That upon acceptance of the appointment to the panel of arbitrators, each
arbitrator shall sign an oath to uphold the terms of Chapter 2, Article VII, Division 7 of the City
Code.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 15th
day of March, A.D. 2005.
