HomeMy WebLinkAbout2004-128-11/16/2004-AUTHORIZING A REVOCABLE PERMIT FOR A PERIOD OF ONE YEAR ON PROPERTY OWNED BY THE CITY FOR USE AS A S RESOLUTION 2004-128 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A REVOCABLE PERMIT FOR A PERIOD OF ONE YEAR ON PROPERTY OWNED BY THE CITY FOR USE AS A STAGING AREA DURING CONSTRUCTION ACTIVITIES WHEREAS,the City of Fort Collins is the owner of that certain real property located in Fort Collins,Latimer County,Colorado,and known as Lee Martinez Park(the"Park")which is adjacent to Lot A and Lot 12,Martinez P.U.D. (the"Development"),an approved commercial development; and WHEREAS, Mason Street North, LLC (the "Developer") requests the City authorize the temporary use of 10,000 square feet of the Park as a staging area during the Developer's construction activities on the Development more specifically described in Exhibit "A", attached hereto and incorporated herein by this reference (hereinafter referred to as the "Permit Area"); and WHEREAS, Mason Street North, LLC will pay to the City in exchange for the Revocable Permit the amount of$1,300.00; and WHEREAS, City staff has reviewed the request to utilize the Permit Area for construction staging purposes, and believes that said construction staging will not interfere with or adversely affect the City owned property, based on current expectations; and WHEREAS,as a condition of the revocable permit,the Developer will be required to return the Permit Area as near to its current condition as possible; and WHEREAS,Article XI, Section 10, of the Charter of the city of Fort Collins authorizes the Council to permit the use of occupation of any street, alley, or public place, provided that such permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is expressly reserved in such permit. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant a revocable permit to Mason Street North,LLC consistent with the terms of this Resolution which shall include such additional terms and conditions as the City Manager,in consultation with the City Attorney, deems necessary or appropriate to protect the interests of the City or effectuate the purposes of this Resolution.
