HomeMy WebLinkAbout1985-091-06/04/1985-MAKING FINDINGS RELATING TO THE APPEAL OF THE ARBOR COMMERCIAL PLAZA, PUD, PRELIMINARY APPROVAL i RESOLUTION 85- 91 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS RELATING TO THE APPEAL OF THE ARBOR COMMERCIAL PLAZA, PUD, PRELIMINARY APPROVAL WHEREAS, on the 31st day of January, 1985, the Planning and Zoning Board of the City of Fort Collins approved the Preliminary Plan for the Arbor Commercial Plaza PUD; and WHEREAS, that decision of the Planning and Zoning Board was appealed to the City Council by City staff; and WHEREAS, the City Council met on the 21st day of March, 1985, considered the appeal of the Arbor Commercial Plaza PUD Preliminary Plan and initially upheld the decision of the Planning and Zoning Board with certain additional conditions to be imposed upon the developer; and WHEREAS, the City Council met on the 2nd day of April , 1985, and voted to reconsider its initial findings on the appeal of the Arbor Commercial Plaza PUD Preliminary Plan; and WHEREAS, the City Council met again on the 21st day of May, 1985, and reconsidered its decision of the 21st day of March, 1985 and concluded it was appropriate to approve the Preliminary Plan on the basis of certain findings and conditions. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: 1. The Planning and Zoning Board's approval of the Arbor Commercial Plaza PUD Preliminary Plan was supported by the evidence submitted to that Board and was consistent with the overall standards, guidelines, and objectives of the Land Development Guidance System of the City of Fort Collins. 2. Any negative impact of the proposed development upon the environment and wildlife habitat in the immediate area of the proposed project can be effectively mitigated and offset by an agreed-upon monetary contribution to the City by the developer, to be used for the possible acquisition and maintenance of other privately-owned property which may be equally suitable for preservation as open space for the use and benefit of the City. 3. The Planning and Zoning Board approval of the Arbor Commercial Plaza PUD Preliminary Plan is upheld with the conditions originally adopted by the Planning and Zoning Board on the 31st day of January, 1985, and the additional condition that twenty five thousand dollars ($25,000.00) be paid by the developer to the City of Fort Collins as a mitigation payment. � i • Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 4th day of June, A.D.//1985.
