OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING A PETITION OF
A PROPERTY OWNER REGARDING THE INITIATION OF A SPECIAL IMPROVEMENT
DISTRICT, STATING THE NEED FOR, THE NATURE OF, AND THE LOCATION OF
THE IMPROVEMENTS TO BE MADE, DESCRIBING THE AREA TO BE ASSESSED
FOR THE SAME, AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO
PREPARE AND PRESENT TO THE CITY COUNCIL THE NECESSARY INFORMATION
FOR THE FORMATION OF SAID DISTRICT.
WHEREAS, the City Council has received a petition from Tri
Trend, Inc. (the "Petitioner" ) , sole property owner in the
proposed Rossborough Special Improvement District No . 85 (the
"District" ) for the creation of a special improvement district for
the purpose of installing certain public improvements in the City;
and
WHEREAS, the City Council has received the petition, accepts
the same, and desires to proceed with the formation of the
District.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS:
Section 1 . That the Petition as submitted by the Petitioner
requesting the formation of the District is hereby received and
accepted.
Section 2. That the improvements to be constructed consist
of street, curb and gutter, street lighting, sidewalk, water
line, sanitary sewer line, and storm drainage improvements. Such
improvements are needed in order to provide adequate access for
vehicles and pedestrians to the properties abutting the streets to
be improved, and in order to provide utility service to properties
within the District.
Section 3. That it is hereby recognized that the street,
street lighting, water, sanitary sewer, and storm drainage
improvements as hereinafter designated will confer special
benefits on the real property in the District and general benefits
to the City at large.
Section 4. That the nature and location of the improvements
to be made in the District are as set forth on Exhibit "A"
attached hereto and by this reference incorporated herein.
Section 5. That the Director of Public Works is hereby
directed to prepare and present to the Council the following:
5.1 Preliminary plans and specifications of the
improvements proposed.
5 .2 An estimate of the total cost of such improvements ,
including the cost of constructing the same, planning,
engineering, legal and advertising costs , interest during
construction and until assessments are made by ordinance against
the properties benefited, and other incidental costs.
5. 3 A map of the District to be assessed for the cost
of improvements .
Section 6. That the area to be assessed for the improvements
described in Section 3 hereof shall be as set forth in the
Petition heretofore submitted by Petitioner.
Section 7. That said improvement District shall be known as
the Rossborough Special Improvement District No . 85.
Passed and adopted at a regular meeting of the City Council
held this 2nd day of April , 1985.

PHASE I IMPROVEMENTS
1 . BIRMINGHAM DRIVE: Located along the northerly side of
Rossborough, Third Filing, and running from its intersection with
Dunbar Avenue to the east boundary line of the Third Filing.
a . Approximately 1 ,399 lineal feet of 36-foot wide,
flow line to flow line, street with drive-over curb, gutter, and
sidewalk on both sides .
