HomeMy WebLinkAbout1996-117-10/01/1996-PURCHASE WIRTGEN 500 ROTOMILL RESOLUTION 96-117 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE PURCHASE OF A WIRTGEN 500 ROTOMILL FROM WIRTGEN AMERICA AS AN EXCEPTION TO THE COMPETITIVE PURCHASING PROCESS WHEREAS, the City Streets Department has a need for a small asphalt milling machine capable of turning tightly enough to grind the area around a manhole cover in one pass, and equipped with a built-in operator's platform and a conveyor for loading spoil directly into a truck; and WHEREAS,based on recent review of available milling machines,the Purchasing Agent has determined that Wirtgen America makes the only small milling machine suitable for the City's needs; and WHEREAS, as a result of that determination, the Purchasing Agent has entered into a lease- purchase agreement with Wirtgen America to lease-purchase the Wirtgen 500 Rotomill machine; and WHEREAS, the lease-purchase agreement is contingent upon the appropriation of sufficient funds and approval of the lease-purchase by the City Council; and WHEREAS, sufficient funds for the lease-purchase payments for the Wirtgen 500 are included in the proposed 1997 budget for Streets; and WHEREAS, Section 8-160 (d) (1) b. of the Code of the City of Fort Collins authorizes the Purchasing Agent to negotiate the purchase of supplies and service without utilizing a competitive process where the Purchasing Agent determines that although a particular material or service is available from more than one (1) responsible source, a competitive process cannot reasonably be used, or, if used, will result in a substantially higher cost to the city, will otherwise injure the city's financial interests or will substantially impede the city's administrative functions or the delivery of services to the public; and WHEREAS, the Purchasing Agent has determined that due to these numerous advantages offered by the Wirtgen 500, and the lack of suitable alternative equipment meeting the City's requirements, the Purchasing Agent has determined that a competitive process cannot reasonably be used and, if used, would result in a substantially higher cost to the city and may result in the impairment of the city's delivery of services to the public, and the Purchasing Agent has submitted the requisite justification for this determination to the City Manager for approval; and WHEREAS, the City Manager has reviewed and approved the justification for this acquisition; and WHEREAS, Section 8-160 (d) (3) requires approval of this purchasing method by the City Council for items costing more than Fifty Thousand Dollars ($50,000) prior to acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is authorized to lease-purchase a Wirtgen 500 milling machine from Wirtgen America in the amount of $87,200 as an exception to the competitive purchasing process requirements.
