OF THE COUNCIL OF THE CITY OF FORT COLLINS
SUPPORTING THE DESIGNATION OF
INTERSTATE HIGHWAY 25 AS THE STATE-APPROVED
ROUTE FOR THE TRANSPORTATION OF
HAZARDOUS MATERIALS IN LARIMER COUNTY
WHEREAS, pursuant to Section 43-6-301, C.R.S. , the Colorado State
Patrol has sole authority to designate which public roads in Colorado shall
be used and shall not be used by motor vehicles transporting hazardous
materials, which designation is to be made after consultation with local
government authorities; and
WHEREAS, the Colorado State Patrol is currently considering a
hazardous materials transportation route proposal which designates
Interstate Highway 25 as the sole north/south route in Larimer County and
does not include any routes west of Interstate Highway 25 in Larimer
County; and
WHEREAS, the proposed route is the most appropriate route in Larimer
County for the following reasons: (a) the route proposed is feasible,
practicable and not unreasonably expensive for the transportation of
hazardous materials, provides for continuity of routes within a
jurisdiction and from one jurisdiction to another, provides greater safety
to the public than other feasible routes and does not unreasonably burden
interstate or intrastate commerce; and (b) the proposed route is not
arbitrary or intended merely to divert the transportation of hazardous
materials to other communities; and
WHEREAS, the City Council supports the designation of Interstate
Highway 25 as the state-approved route for the transportation of hazardous
materials in Larimer County and believes that it is in the public's
interest, for the protection of the public's health, safety and welfare, to
have the designation made by the Colorado State Patrol as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City supports the designation of Interstate
Highway 25 as the state-approved route for the transportation of hazardous
materials in Larimer County, as currently proposed and under consideration
by the Colorado State Patrol .
Section 2. That the City objects to the designation of any alternate
routes for the transportation of hazardous material in Larimer County which
would pass through the City of Fort Collins.
