OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A REVOCABLE PERMIT OVER A PORTION
OF THE PUBLIC UTILITY EASEMENT ADJACENT TO CENTRE AVENUE
BY THE HORTICULTURE CENTER FOR INSTALLATION OF
A DUCT BANK FOR FIBER OPTIC LINE BY
COLORADO STATE UNIVERSITY
WHEREAS, the City of Fort Collins (the"City") is the owner of the property known as the
Tract A, Centre for Advanced Technology, 22nd Filing, in the City of Fort Collins, Colorado, also
known as the Horticulture Center or the Gardens on Spring Creek (hereinafter referred to as the
"Property"); and
WHEREAS, prior to the City's ownership of the Property, Colorado State University
("CSU") had installed a fiber optic line with the verbal permission of the prior owner, Colorado
State University Research Foundation (the "Prior CSU Line"); and
WHEREAS, during grading of the Property for the Horticulture Center Project, the Prior
CSU Line was encountered and was determined to interfere with the Project as planned, and as a
result, CSU removed the Prior CSU Line; and
WHEREAS,in connection with the plat of the Property for the Horticulture Center Project,
the City identified a 15-foot wide public utility easement on the Property along the west side of
Centre Avenue (the "Utility Easement"); and
WHEREAS, in order to replace the Prior CSU Line, and to provide for future expansion of
fiber optic capabilities, CSU wishes to locate a new duct bank consisting of four 1114 inch conduits
for fiber optic line, and within the Utility Easement consistent with the section drawing of the duct
bank attached hereto as Exhibit "A", and incorporated herein by this reference (the "Duct Bank"),
together with associated vault improvements; and
WHEREAS, the Duct Bank will be located in the easterly two (2) feet of the Utility
Easement, adjacent to the west edge of the sidewalk, as generally shown on the plan drawing
attached hereto as Exhibit `B" and incorporated herein by this reference (the "Permit Area"); and
WHEREAS,installation of the Duct Bank in the Permit Area has been determined to be less
disruptive than installation of the Duct Bank in the Centre Avenue right-of-way; and
WHEREAS,City staff has reviewed the request to install the above-described improvements
in the Permit Area, and believes that said installation will not interfere with or adversely affect the
Horticulture Center Project or the City's use of the Property, based on current expectations; and
WHEREAS, CSU has agreed to coordinate the timing of its work with the Horticulture
Center Project, and to begin and complete its work immediately upon completion of the required
revocable permit documents; and
WHEREAS, the detailed plans for construction, including backfill and restoration of the
Permit Area upon completion of work by CSU,and the work,shall be subject to review and approval
by City staff in order to ensure that no adverse impacts upon the Horticulture Center Project or other
City improvements will result; and
WHEREAS, Article XI, Section 10,of the Charter of the City of Fort Collins authorizes the
Council to permit the use or occupation of any street, alley, or public place, provided that such
permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is
expressly reserved in such permit.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant
a revocable permit consistent with the terms of this Resolution,to CSU as described herein,together
with such additional terms and conditions as the City Manager, in consultation with the City
Attorney, deems necessary or appropriate to protect the interests of the City or effectuate the
purposes of this Resolution.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins
commenced on the 15th day of July A.D. 2003, and concluded on this 22; y of July A.D. 2003.
