OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE AN
INTERGOVERNMENTAL AGREEMENT BETWEEN
THE CITY OF FORT COLLINS AND
THE STATE OF COLORADO, DEPARTMENT OF HIGHWAYS
ESTABLISHING AN ACCESS CONTROL PLAN AS ALLOWED
BY THE STATE HIGHWAY ACCESS CODE FOR HARMONY ROAD/COUNTY ROAD 68
BETWEEN BOARDWALK DRIVE AND I-25 WITHIN THE CITY LIMITS
WHEREAS, the City of Fort Collins (City) and the State of Colorado
Department of Highways (State) desire to enter into an agreement regulating
vehicular access to those sections of Harmony Road/County Road 68 between
Boardwalk Road and I-25 within the city limits; and
WHEREAS, said portion of Harmony Road/County Road 68 is regulated by
the State Highway Access Code, 1985 as amended; and
WHEREAS, regulation of vehicular access is necessary to maintain an
efficient and smooth flow of traffic, to protect the functional level and
maximize the traffic capacity of Harmony Road/County Road 68, to provide an
efficient spacing of traffic control signals, and to protect the public
health, safety and welfare; and
WHEREAS, the City and the State desire to bring this portion of
highway into conformance with the State Highway Access Code to the extent
feasible given existing conditions pursuant to Section 2.12 of said Code
pertaining to the establishment of Access Control Plans; and
WHEREAS, the City and the State desire to reach a comprehensive and
mutually acceptable solution to the existing and potential future access;
and
WHEREAS, the Planning and Zoning Board of the City has held a public
meeting regarding the proposed Access Control Plan, has reviewed the same,
and has recommended adoption thereof by Intergovernmental Agreement; and
WHEREAS, the City Council has reviewed said Access Control Plan and
finds that it is in the best interest of the City that the City and State
enter into an Intergovernmental Agreement for the purpose of adoption and
implementing said Access Control Plan; and
WHEREAS, the City Charter, at Article II, Section 16, provides that
the Council may, by ordinance or resolution, enter into contracts with
other governmental bodies to enter into cooperative or joint activities
with other governmental bodies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, AS FOLLOWS:

Section 1. That the City of Fort Collins approves the Harmony Road
Access Control Plan as recommended by the Planning and Zoning Board on
January 5, 1989.
Section 2. That the Mayor hereby is authorized to enter into an
intergovernmental agreement between the City and the State, for the purpose
of adopting and implementing an Access Control Plan for Harmony Road/County
Road 68 between Boardwalk Drive and I-25.
Passed and adopted at a regular meeting of the Council of the City
of Fort Collins held this 17th day of January, A D. 1989.
