HomeMy WebLinkAbout1994-084-05/17/1994-CHOICES 95 EASTSIDE NEIGHBORHOOD PARK IGA LAUREL ELEMENTARY SCHOOL POUDRE SCHOOL DISTRICT R-1 OPTION IA RESOLUTION 94-84 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT TO PURCHASE 1.89 ACRES FROM POUDRE R-1 FOR THE EASTSIDE NEIGHBORHOOD PARK ADJACENT TO LAUREL ELEMENTARY SCHOOL AND PROVIDING DIRECTION FOR FURTHER EXPENDITURE OF FUNDS FOR THE EASTSIDE NEIGHBORHOOD PARK WHEREAS, the City of Fort Collins is committed to providing for the recreational needs of its citizens through the acquisition and development of neighborhood parkland; and WHEREAS, the citizens of Fort Collins voted to fund the acquisition and development of an Eastside Neighborhood Park; and WHEREAS, the Council of the City of Fort Collins has an adopted policy to cooperate with the Poudre R-1 School District in the acquisition and development of recreational facilities; and WHEREAS, the City has an opportunity to purchase a 1 .89 acre neighborhood park from the Poudre School District R-1 adjacent to the newly expanded Laurel School , for the price of $135,166, including reimbursement for cleanup costs; and WHEREAS, this site meets the Parks and Recreation Master Plan location for a neighborhood park in the eastern section of the City; and WHEREAS, the Council . finds it is in the best interests of the City to acquire this neighborhood park site; and WHEREAS, funds for this purchase are available from the Capital Projects Fund - Choices 95; and WHEREAS, remaining funds from the Capital Projects Fund - Choices 95 will be available for acquisition of additional parkland in this area; and WHEREAS, an ad hoc citizen committee has been formed by interested residents for the purpose of studying opportunities for integrating the additional parkland with other public improvements to be acquired and developed in the area by the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the City Manager be, and hereby is, authorized to enter into an Agreement between the City of Fort Collins and Poudre School District R-1 for the purchase of 1 .89 acres of land as more particularly described on attached Exhibit "A", which is incorporated herein by this reference, and reimbursement for clean-up costs for the amount of One Hundred Thirty-Five Thousand One Hundred Sixty-Six Dollars ($135,166) to be paid from the Capital Projects Fund - Choices 95. Section 2. That City staff is hereby directed to continue negotiations to acquire additional acreage to be developed as parkland in the Eastside Neighborhood in the immediate vicinity of the Laurel School and any funds in the Choices 95, Eastside Neighborhood Park account remaining after the acquisition and development of the park site adjacent to the Laurel School , including the 1 .89 acres referred to in Section 1 above, are hereby dedicated for that purpose. Section 3. That City staff is further directed to prepare an integrated development plan in the neighborhood of the Laurel School that provides for the coordination of land acquisition and development of property for public projects in the area which are currently planned or projected by the City for storm drainage, natural areas, parks, trails, streets and sidewalks and other City improvements Section 4. That City staff shall consult with a citizen advisory committee, made up of residents from the surrounding Eastside Neighborhood, in preparing such development plan. Section 5. That the foregoing integrated development plan be presented to the City Council within three (3) months of the date of passage of this Resolution and prior to the expenditure of any City funds for the development of the parkland described above. PARCEL FOUR (4 ) Commencing at a point which bears South from the North- west corner of the Southeast Quarter of the Northeast Quarter of Section 13, Township 7 North, Range 69 West of the 6th P.M. , 493.8 feet and again East 191 .8 feet to the TRUE POINT OF BEGINNING, thence east 233 feet, thence North 18.8 feet, thence East 280.7 feet, thence North 5 feet, thence westerly along a chain link fence as extended 305.7 feet more or less to the east line of Herbertson Addition, thence South to the Southeast corner of Herbertson Addition, thence West along the South line of Herbertson Addition to the Southwest corner of Herbertson Addition, thence south 18 . 8 feet, thence east to the TRUE POINT OF BEGINNING. -
