HomeMy WebLinkAbout1992-166-11/03/1992-COLORADO STATE UNIVERSITY CSU ANNEXATIONS CSU BUILDINGS SIGNS STRUCTURES IGA NEGOTIATIONS RESOLUTION 92-166 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING NEGOTIATIONS WITH COLORADO STATE UNIVERSITY REGARDING AN INTERGOVERNMENTAL AGREEMENT, AND IDENTIFYING AREAS OF CONCERN TO BE ADDRESSED BY THE AGREEMENT WHEREAS, pursuant to Section 29-1-203, C.R.S. , governments may cooperate or contract with one another to provide any function, service or facility lawfully authorized to each of the cooperating or contracting units of government; and WHEREAS, any such contract may provide for the joint exercise of the function, service or facility which is the subject of the contract; and WHEREAS, because of the location of the Colorado State University ("CSU") main campus in the heart of the City, and because of the extensive economic, cultural , social and demographic influence that CSU exercises in the City, it is imperative that both the City and CSU cooperate to the greatest extent possible with regard to issues that touch and concern both the City and CSU; and WHEREAS, CSU continues to develop and construct improvements upon its main and auxiliary campuses and other lands owned by CSU, which development and construction can generate land use influences upon the adjacent properties in the City, as well as upon the coordination of City utility, traffic and transportation installations; and WHEREAS, the growth and development of the City in areas adjacent to CSU campuses or other lands can create influences upon the development of such CSU campuses and lands; and WHEREAS, the City believes it would be in the best interests of the community to enter into an intergovernmental agreement with CSU for the purpose of providing a formal framework for the establishment of greater cooperation, coordination and communication with respect to issues pertaining to land use, land development, annexation, utility and traffic coordination or other related issues . NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the City Manager is hereby directed to enter into negotiations with CSU to develop an intergovernmental agreement as described above. Section 2. That such intergovernmental agreement should acknowledge the benefits to the community of closer cooperation and coordination of activities between CSU and the City and should include, without limitation, provisions addressing the following subjects: a. The City's annexation of properties owned by CSU as such properties become eligible for annexation under Colorado law, and the terms and conditions under which such properties should be annexed. b. A process for reviewing any CSU buildings, signs or other structures proposed to be located within a defined area which the parties agree may impact the citizens of the City of Fort Collins. Such review procedure should provide for adequate community input and should specify the nature of the City's involvement in the review of any specific land use proposals on CSU property, the weight to be afforded any input from the City with regard to such proposals and the officials or employees of CSU who shall be responsible for any final decisions regarding such proposed uses. C. Landscaping standards and criteria to be utilized by CSU for the construction of buildings, signs or other structures that are proposed to be constructed within the geographical area referenced above. d. A process for permitting mutual involvement in any decision of CSU or the City which may have a direct and substantial impact on the operations of both parties. e. The responsibilities of the parties in planning and funding any infrastructure needed to meet the utility and transportation needs generated by any CSU construction activities.
