OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH POUDRE R-I SCHOOL DISTRICT FOR THE JOINT
USE OF TRANSFORT'S BUS WASH AND FUELING FACILITIES
WHEREAS, the City of Fort Collins ("the City") owns a facility known as
"Transfort" located at 6570 Portner Road in Fort Collins, Colorado, for bus
transit operations, which facility includes a bus wash and fueling facility; and
WHEREAS, Poudre School District R-1 ("the District") intends to purchase
a 6.8551 acre parcel of land adjacent to the Transfort site for the storage and
maintenance of school buses; and
WHEREAS, the City wishes to cooperate with the District to allow the joint
use of the City's bus wash and fueling facilities at the Transfort site in an
effort to provide efficient and cost- saving public services to the Fort Collins
community; and
WHEREAS, the Agreement would allow the District to have access and the
right to use the Transfort bus wash and fueling facilities at times that do not
interfere with Transfort's use of these facilities, for a period of up to ten
(10) years but subject to termination by either party upon one hundred eighty
(180) days written notice; and
WHEREAS, the Agreement would require the District to pay for the fuel and
bus wash services it will receive and for the additional costs that may be
incurred by the City due to the District's use of these facilities; and
WHEREAS, the District will provide Fifty Thousand Dollars ($50,000) to the
City for the purpose of upgrading the bus wash facility from a brush system to
a brushless system, with the contributed amount being applied as a credit against
the costs to the City of the District's use of the bus wash facility; and
WHEREAS, the Agreement provides that the District will reimburse the City
for all amounts the City is required to repay to the federal government for
federal funds used in constructing the original bus wash and fueling facilities,
due to the District's use; and
WHEREAS, Article II, Section 16, of the City Charter provides that the City
Council may, by ordinance or resolution, enter into contracts with other
governmental bodies to furnish governmental services and to make charges for such
services or to enter into cooperative or joint activities with other governmental
bodies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor is authorized to enter into an Intergovernmental Agreement between
the City of Fort Collins and the Poudre School District R-1 to allow the District
access to and the use of the City's Transfort bus wash and fueling facilities in
accordance with the terms and provisions set forth herein.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 3rd day of November, A.D. 1992.
