OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS
OF CERTAIN LAND FOR PARKING, PUBLIC ACCESS AND
FIRE PROTECTION PURPOSES
WHEREAS, the City of Fort Collins desires to acquire certain real property,
more particularly described in Exhibits "A" and "B", attached hereto and
incorporated herein by this reference, for parking, access and fire protection
purposes; and
WHEREAS, the City has previously negotiated in good faith for the
acquisition of said property from the owner thereof, which negotiations have been
unsuccessful ; and
WHEREAS, the acquisition of the property is desirable and necessary to meet
the need for parking and transportation in the downtown area of the City and to
provide fire protection, and is in the public interest and enhances the public
health, safety and welfare; and
WHEREAS, the acquisition of such property may, by law, be accomplished
through proceedings of eminent domain.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the City hereby finds and determines that it is necessary
in the public interest to acquire the real property described on attached Exhibit
"A, " for public parking purposes and on Exhibit "B" for public access and fire
protection purposes.
Section 2. That the City Council hereby authorizes the City Attorney and
other proper officials of the City to acquire the said real property for the City
by eminent domain proceedings.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 15th day of September, A.D. 1992.

DESCRIPTION OF THE PROPOSED TRILLIUM ALLEY CONDEMNATION
Two tracts of land located in the Northeast One Quarter of Section
11 Township 7 North, Range 69 West of the Sixth Principal Meridian,
City of Fort Collins, Larimer County, Colorado, also being located
in Block 22 of the City of Fort Collins, more particularly
described as follows;
The Easterly 22 . 60 feet of Lots 22 through 35 inclusive, of the
said Block 22 . Containing 7910 square feet more or less.
TOGETHER WITH:
The Easterly 7 .60 feet of Lot 42 and the Westerly 12 .40 feet of Lot
43, of the said Block 22 . Containing 3100 square feet more or
less.
The above described tracts are subject to all easements and rights
of ways now existing or of record.
I hereby state that the above description was prepared by me and is
true and correct to the best of my professional knowledge, belief
and opinion. The description and areas shown are based upon
previously recorded plats and deeds and not upon a actual field
survey.
