OF THE COUNCIL OF THE CITY OF FORT COLLINS
DETERMINING THAT THE COUNCIL SHOULD CONSIDER
WHETHER THE ZONING ESTABLISHED FOR THE "BUFFER
STRIP" BY ORDINANCE NO. 113, 1991, IS THE APPROPRIATE
ZONE FOR THAT STRIP OF LAND AND DIRECTING CITY STAFF
TO PREPARE THE NECESSARY AGENDA MATERIALS FOR
CONSIDERATION OF THAT QUESTION AND REQUESTING A
NEW REPORT AND RECOMMENDATION FROM THE PLANNING
AND ZONING BOARD REGARDING THE APPROPRIATE
ZONING FOR SAID PROPERTY
WHEREAS, on September 17, 1991, and on October 15, 1991 , the City Council
considered certain amendments to Ordinance No. 113, 1991, pertaining to a "buffer
strip" to be located between the "B-G" General Business Zone and the "N-C-M"
Neighborhood Conservation Medium Density Zone in that strip of land described on
Exhibit "A, " attached hereto and incorporated herein by this reference, which
strip shall hereafter be referred to as the "Property" ; and
WHEREAS, prior to City Council 's consideration of the zoning to be applied
to the Property, City Council had received the report and recommendation of the
Planning and Zoning Board as required pursuant to Section 29-43 and Section 29-44
of the Code; and
WHEREAS, it has been alleged that a conflict of interest existed with
respect to the participation of Councilmember Edwards in the City Council ' s
deliberations and vote regarding the zoning for the Property; and
WHEREAS, the Council Ethics Review Board has reviewed this matter, has
rendered an advisory opinion that Councilmember Edwards' inadvertently failed to
recognize a personal conflict of interest with regard to Council 's zoning of the
Property and has recommended that Council reconsider whether the zoning
established for the Property is appropriate; and
WHEREAS, in order to ensure that the zoning of the Property has been
reviewed impartially, the City Council has determined that it would be in the
best interests of the City that the City Council again consider whether the
zoning established for the Property pursuant to Ordinance No. 113, 1991 , is the
appropriate zone for that Property; and
WHEREAS, the City Council has determined that the Planning and Zoning Board
should again study the zoning issues for the Property and present a new report
and recommendation to the City Council .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the City Council desires to consider whether the zoning
established pursuant to Ordinance No. 113, 1991, for the Property as more
particularly described on Exhibit "A, " is the appropriate zone for said Property.
Section 2. That the Planning and Zoning Board shall , prior to Council ' s
consideration, study the zoning issues `or the Property and present a new report
and recommendation to the City Council according to the procedures contained in
Section 29-44 of the City Code.
Section 3. That the City staff shall , following receipt by the Council of
the report and recommendation of the Planning and Zoning Board, promptly present
to the City Council all necessary agenda materials to conduct such zoning
consideration.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 1st day of September, A.D. 1992.
