HomeMy WebLinkAbout1995-024-02/21/1995-CHOICES 95 PROJECTS EMINENT DOMAIN PROCEEDINGS INTERSECTION IMPROVEMENTS PROSPECT ROAD COLLEGE AVENU RESOLUTION 95-24 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE FINAL DESIGN OF TWO CHOICES 95 PROJECTS (PROSPECT ROAD AND COLLEGE AVENUE INTERSECTION IMPROVEMENTS AND PROSPECT ROAD AND LEMAY AVENUE INTERSECTION IMPROVEMENTS) AND AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LAND NECESSARY FOR THE CONSTRUCTION OF SAID PROJECTS WHEREAS, on March 7, 1989, the voters of the City approved the imposition of an additional quarter-cent sales and use tax for the purpose of funding certain capital projects (the "Choices 95 Projects"); and WHEREAS,included among the Choices 95 Projects were certain Streets and Transportation Capital Projects (the "Street Projects") ; and WHEREAS, the Street Projects include improvements at the intersection of Prospect Road and College Avenue and the intersection of Prospect Road and Lemay Avenue (the "Prospect- College and Prospect-Lemay Projects"); and WHEREAS, the final design of the Prospect-College and Prospect-Lemay Projects was presented to the City Council by the Director of Engineering in a worksession on July 12, 1994; and WHEREAS, the City Council wishes to formally approve the kinds of improvements to be constructed in connection with said projects; and WHEREAS, it is necessary for the City to acquire certain properties hereinafter described for the purpose of constructing street, utilities, and pedestrian improvements in connection with the foregoing projects; and WHEREAS, the City has previously negotiated in good faith for the acquisition of said properties from the owners thereof, which negotiations have been unsuccessful; and W iERFA S,the acquisition of the properties is desirable and necessary for the construction of the improvements,is in the public interest and enhances the public health, safety and welfare; and WHEREAS, the acquisition of such properties may, by law, be accomplished through proceedings in eminent domain. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby approves the following intersection improvements to be constructed at the Prospect Road and College Avenue intersection and at the Prospect Road and Lemay Avenue intersection: Prospect Road - College Avenue Construct double left turn lanes for northbound and southbound College Avenue; Construct southbound and westbound right turn lanes. Prospect Road - Lemay Avenue Construct southbound right turn lane. Section 2. That the City Council hereby finds and determines that it is necessary in the public interest to acquire the real property described on attached Exhibit "A", pages 1 through 26, which is incorporated herein by this reference, for the purpose of constructing street, utilities, and pedestrian improvements in connection with the above-described properties. Section 3. That the City Council hereby authorizes the City Attorney and other appropriate officials of the City to acquire the said real property for the City by eminent domain proceedings. Section 4. The City Council finds, in the event that acquisition by condemnation of any parcel described in this Resolution is commenced, that immediate possession is necessary for the public health, safety and welfare.
