OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT
WITH THE UNION PACIFIC RAILROAD COMPANY FOR
CROSSING IMPROVEMENTS AND RIGHT-OF-WAY
ON EAST PROSPECT ROAD
WHEREAS, the Union Pacific Railroad Company has tendered to the City
of Fort Collins, a municipal corporation of the State of Colorado, a
contract covering installation of automatic flashing light signals and
gates, Mile Post 22.63, and rights agreement near Fort Collins, Colorado;
such agreement being identified in the records of the Railroad Company as
its C.D. No. 35287-4; and
WHEREAS, the Council of the City of Fort Collins has given said
agreement careful consideration; and
WHEREAS, it is considered that the best interests of the City will be
subserved by the acceptance of said agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1 . That the terms of the agreement submitted by the Union
Pacific Railroad Company as aforesaid are accepted in behalf of the City.
Section 2. That the Mayor be, and hereby is, authorized, empowered,
and directed to execute said agreement on behalf of the City and that the
City Clerk be, and hereby is, authorized and directed to attest said
agreement and to attach to each duplicate original of said agreement a
certified copy of this resolution.
Passed and adopted at a regular meeting of the City Council held this
4th day of March, A.D. 1986.
