HomeMy WebLinkAbout1986-004-01/07/1986-APPEAL FINDINGS FAMILY DEFINITION RESOLUTION 86- 4 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS RELATING TO THE APPEAL OF THE DEFINITION OF FAMILY WHEREAS, on the 14th day of November, 1985, the Zoning Board of Appeals of the City of Fort Collins affirmed City staff's determination that two related individuals and two unrelated individuals living together do not constitute a legal family; and WHEREAS , the Zoning Board of Appeals also affirmed staff ' s determination that four unrelated individuals living together do not constitute a legal family; and WHEREAS, that decision of the Zoning Board of Appeals was appealed to the City Council by the applicant; and WHEREAS, the Zoning Code of the City of Fort Collins permits only one family to live in a dwelling unit; and WHEREAS, 'family' is defined in Section 118-11 of the Code of the City of Fort Collins to be "an individual or two (2) or more persons related by blood or marriage or an unrelated group of not more than three (3) persons living together in a dwelling unit" ; and WHEREAS, the City Council met on the 17th day of December, considered the appeal on the definition of family and voted to sustain the decision of the Zoning Board of Appeals. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS: 1. Two related individuals and two unrelated individuals living together do not constitute a legal family. 2. Four unrelated individuals living together do not constitute a legal family. 3. The decision of the Zoning Board of Appeals and the determination of the Zoning Administrator as to the definition of family pursuant to the Code of the City of Fort Collins is hereby sustained.
