OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE GRANT OF AN AMENDED EASEMENT
TO ANHEUSER-BUSCH
WHEREAS, pursuant to Resolution 85-29, the Council did, on February 19,
1985, authorize the conveyance of certain easements to Anheuser-Busch for a
process waste water line; and
WHEREAS, as a result of the final design of the line, it has now been
discovered that changes in the alignment would reduce the cost of
construction and provide the least disruption to the present vegetation and
terrain; and
WHEREAS, said amended easement encroaches, in certain locations, upon a
pre-existing easement belonging to the Boxelder Sanitation District; and
WHEREAS, the proposed easement is made expressly contingent upon the
approval of said District; and
WHEREAS, the Council of the City of Fort Collins does hereby determine
that the aforesaid property is not used or intended to be used for
municipal purposes, nor secured for the purpose of being used for municipal
purposes, and that it is for the best interests of the City of Fort Collins
that an amended easement for process waste water line be granted and
conveyed to Anheuser-Busch; and
WHEREAS, inasmuch as Anheuser-Busch has previously paid to the City
market value consideration for the original easement, the Council does
hereby determine that the said amended easement shall be conveyed to
Anheuser-Busch for nominal consideration.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor and the City Clerk be, and they hereby are,
authorized to execute such good and sufficient deed of conveyance as may be
necessary to effectuate the aforesaid transfer of amended easement.

4th day of March, A. D. 1986.
