OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING THE PETITION
OF THE PROPERTY OWNER REGARDING THE INITIATION OF THE ARBOR PLAZA
SPECIAL IMPROVEMENT DISTRICT, STATING THE NEED FOR, THE NATURE
OF, AND THE LOCATION OF THE IMPROVEMENTS TO BE MADE, DESCRIBING
THE AREA TO BE ASSESSED FOR THE SAME, AND DIRECTING THE DIRECTOR
OF PUBLIC WORKS TO PREPARE AND PRESENT TO THE CITY COUNCIL THE
NECESSARY INFORMATION FOR THE FORMATION OF SAID DISTRICT.
WHEREAS, the Council of the City of Fort Collins,
Colorado (the "Council" ) , has received the Petition from the
property owner in the area (the "Petitioner" ) of the proposed
ARBOR PLAZA SPECIAL IMPROVEMENT DISTRICT ( the "District" )
requesting that Council initiate proceedings for the creation of
a special improvement district for the purpose of acquiring,
constructing, and installing street, water, sanitary sewer, and
minor storm drainage improvements in the City of Fort Collins,
Colorado ( the "City" ) ; and
WHEREAS, the Council has received the Petition, accepts
the same, and desires to proceed with the formation of the
District.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF FORT COLLINS:
Section 1. That the Petition as submitted by Petitioner
requesting the formation of the District is hereby received and
accepted.
Section 2. That the improvements to be constructed con-
sist generally of street improvements ( including curb, gutter,
sidewalk, asphalt, base course and grading) , water distribution
system, sanitary sewer system, and minor storm drainage system
improvements. Such improvements are needed in order to provide
adequate access for vehicles and pedestrians to the properties
abutting the streets to be improved, and in order to provide
adequate utility service to properties within the District .
Section 3. That it is recognized that the street, water,
sewer, and minor storm drainage improvements as hereinafter
designated, will confer special benefits on the real property in
the District and general benefits to the City at large.
Section 4. That the nature and location of the improve-
ments to be made in the District are as follows:
A. Streets
Street improvements, including curb, gutter,
sidewalk, asphalt, base course and grading will be made for Mason
Street, Harmony Road, and South College Avenue. The Mason Street
improvements commence approximately 550 feet north of Harmony
Road and extend southerly approximately 1470 feet to an intersec-
tion with South College Avenue. The Harmony Road improvements
extend east of the center line of South College Avenue approxi-
mately 520 feet and west of the center line of South College
avenue approximately 1150 feet. The South College Avenue
improvements commence at the flow line intersection of the south-
west corner of Harmony Road and South College Avenue and extend
south approximately 750 feet along the west side of South College
Avenue.

B. Water
The water distribution system will provide
8-inch lines which generally run through the site in two loca-
tions connecting to the existing Harmony Road main to the north
of the site and the existing South College Avenue main to the
east of the site.
C. Sanitary Sewer
Sanitary sewer will be a system of 8-inch
mains and appurtenances flowing to an existing 8-inch outfall
main south of the District.
D. Storm Drainage
Storm drainage will consist of a series of
18-inch reinforced concrete storm sewer mains, catch basins, and
release structures and the portion of an 8 foot by 6 foot box
culvert located under the Mason Street right-of-way to carry the
100-year design flows of Mail Creek and the New Mercer Canal
which currently traverses the site in an open channel.
Section 5. That the Director of Public Works is directed
to prepare and present to the Council the following:
a. Preliminary plans and specifications of the
improvements proposed.
b. An estimate of the total cost of such improve-
ments, including the cost of planning, acquiring and constructing
the same, engineering, legal and advertising costs, interest
during construction and until assessments are made by ordinance
against the properties benefited, and other incidental costs .

C. A map of the District to be assessed for the
cost of improvements.
Section 6. That the area to be assessed for the improve-
ments described in Section 4 shall be as set forth in the
Petition heretofore submitted by Petitioner .
Section 7 . That said improvement District shall be known
as the Arbor Plaza Special improvement District No. 88.
Passed and adopted at a regular meeting of the City
Council held this 4th day of February 1986 .
