OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE COOPERATION AGREEMENT BETWEEN
THE CITY OF FORT COLLINS AND THE CITY OF
FORT COLLINS HOUSING AUTHORITY ENTERED INTO
ON DECEMBER 16, 1971
WHEREAS, on December 16, 1971, the City of Fort Collins and the City
of Fort Collins Housing Authority ("Authority") entered into a Cooperation
Agreement which set out the relationship between the City and the
Authority; and
WHEREAS, Paragraph 3. (a) provides in part that the Authority shall
make annual payments called "Payments in Lieu of Taxes" in payment for the
public services and facilities furnished from time to time; and
WHEREAS, the Authority has insufficient revenues to pay the amount
required for payment in lieu of taxes pursuant to the Cooperation
Agreement; and
WHEREAS, the City has and continues to support activities of the
Authority by the purchase of the public benefits provided by that Authority
thru the provision of low income housing; and
WHEREAS, the City and the Authority desire to amend the terms of said
Cooperation Agreement to delete the requirement for the Payment in Lieu of
Taxes so that the Authority is relieved further of that obligation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and he hereby is, authorized to execute an
amendment to the Cooperation Agreement entered into on the 16th day of
December, 1971, by and between the City of Fort Collins and the City of
Fort Collins Housing Authority, such amendment providing for the deletion
from said Cooperation Agreement of Paragraph 3 therein in its entirety.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 4th day of November, A.D. 1 6.
