OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A CHANGE IN LOCATION OF THE
RIGHT-OF-WAY EASEMENT GRANTED TO POUDRE VALLEY
RURAL ELECTRIC ASSOCIATION AT WATER PLANT #1
WHEREAS, Poudre Valley Rural Electric Association ("PVREA") provides
electric power to the City's Water Plant #1; and
WHEREAS, as part of the Water Treatment Plant Relocation Project, a
presedimentation basin is being built on the current right-of-way for the
electric lines of PVREA; and
WHEREAS, in order to continue electric service to Water Plant #1 it is
necessary to relocate a portion of PVREA's electric line to circumvent the
presedimentation basin as such relocated right-of-way is shown on the map
attached hereto; and
WHEREAS, the Council does hereby find, in accordance with Section 26-2
of the Code of the City, that said relocated right-of-way (only) is not
used nor intended to be used, for municipal purposes and it is in the best
interest of the City that the same be conveyed to the PVREA.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor and City Clerk be authorized to execute that certain
Right-of-Way Agreement between the City and Poudre Valley Rural Electric
Association, conveying to PVREA that certain right-of-way as shown on the
map attached hereto.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of October, A.D. 198 .
