OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE FILING AND EXECUTION OF AN
UMTA SECTIONS 5 AND 9 OPERATING ASSISTANCE,
PLANNING AND CAPITAL GRANT FOR TRANSFORT
WHEREAS, the Secretary of Transportation is authorized to make grants
for mass transportation projects; and
WHEREAS, the contract for financial assistance will impose certain
obligations upon the applicant, including the funding of the local share of
projects ' costs; and
WHEREAS, it is required by the U.S. Department of Transportation in
accord with the provisions of Title VI of the Civil Rights Act of 1964,
that in connection with the filing of an application for assistance under
the Urban Mass Transportation Act of 1964, as amended, the applicant gives
an assurance that it will comply with Title VI of the Civil Rights Act of
1966 and the U.S. Department of Transportation requirements thereunder; and
WHEREAS, it is the goal of the applicant that minority business
enterprises be utilized to the fullest extent possible in connection with
these projects , and that definite procedures shall be established and
administered to ensure that minority business shall have the maximum
feasible opportunity to compete for contracts when procuring construction
contracts, supplies, equipment contracts, or consultant and other services;
and
WHEREAS, upon the commitment of local matching funds in the amount of
Three Hundred Six Thousand Eight Hundred and Thirty-Nine Dollars ($306,839)
and a local match of Ten Thousand Four Hundred Dollars ($10,400) , a federal
grant for operating assistance in the amount of Three Hundred Sixty-Five
Thousand Two Hundred and Three Dollars ($365,203) , a planning grant of Nine
Thousand Six Hundred Dollars ($9,600) for development of a feasible plan
for blending a specialized and standard transportation fleet, and a capital
grant of Thirty-Two Thousand Dollars ($32,000) for a spare power plant and
improvements in turning radii at four intersections could be approved; and
WHEREAS, the Council of the City of Fort Collins has determined that
it is in the best interest of the City that a grant application requesting
funding in the amount of Four Hundred and Six Thousand Eight Hundred and
Three Dollars ($406,803) pursuant to Sections 5 and 9 of the Urban Mass
Transportation Act of 1964, as amended, be executed by the City Manager and
submitted to the Urban Mass Transportation Administration.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Manager be, and hereby is, authorized to
execute and file applications on behalf of the City of Fort Collins,
Colorado, with the U.S. Department of Transportation to aid in the
financing of planning, capital and/or operating assistance projects
pursuant to Section 9 of the Urban Mass Transportation Act of 1964, as
amended.
Section 2. That the City Manager be, and hereby is, authorized to
execute and file with such application, an assurance or any other document
required by the U.S. Department of Transportation effectuating the purposes
of Title VI of the Civil Rights Act of 1964.
Section 3. That the City Manager be, and hereby is, authorized to
furnish such additional information as the U . S . Department of
Transportation may require in connection with the application or the
project.
Section 4. That the City Manager be, and hereby is, authorized to set
forth and execute affirmative minority business policies in connection with
the project 's procurement needs.
Section 5. That the City Manager be, and hereby is, authorized to
execute grant agreements on behalf of the City of Fort Collins, Colorado
with the U.S. Department of Transportation for aid in the financing of the
planning, capital and/or operating assistance program of projects.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 18th day of June, A.D. 1985.
