HomeMy WebLinkAbout1985-116-07/16/1985-MAKING FINDINGS RELATING TO THE APPEAL OF THE CUNNINGHAM CORNERS MASTER PLAN AMENDMENT RESOLUTION 85- 116 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS RELATING TO THE APPEAL OF THE CUNNINGHAM CORNERS MASTER PLAN AMENDMENT WHEREAS, on the 29th day of April , 1985, the Planning and Zoning Board of the City of Fort Collins denied an amendment to the Cunningham Corners Master Plan; and WHEREAS, that decision of the Planning and Zoning Board was appealed to the City Council by the applicant ; and WHEREAS, the City Council met on the 2nd day of July, 1985, considered the appeal of the Cunningham Corners Master Plan amendment and reversed the decision of the Planning and Zoning Board with certain additional conditions to be imposed upon the developer; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: 1. The proposed amendment of the Cunningham Corners Master Plan was supported by the evidence submitted to the City Council and was consistent with the overall standards, guidelines, and objectives of the Land Development Guidance System of the City of Fort Collins. 2. The Planning and Zoning Board denial of the Cunningham Corners Master Plan amendment is reversed, and the amendment approved with the following conditions: a. That Windmill Drive be vacated and adjoining single family property owners accept the ROW. The applicants are to provide all the necessary documentation for the vacation. b. That the existing pavement, curb and gutter, sidewalk, etc. in Windmill Drive be removed and replaced with an acceptable ground cover treatment, the cost of which will be borne by the applicants. c. That the applicants bear the cost of any removal or relocation of existing utilities, including shutting off at the main. The applicants are to provide the necessary vacation or dedication documents for any unneeded easements. d. That a sidewalk be provided between Gunnison Drive and Richmond Drive. The applicants are to bear the cost of installation of the sidewalk and dedicate the required public access easements . e. That the applicants are to fulfill these requirements as part of the approval of any future phases of the Cunningham Corners Master Plan.
