RESOLUTION 85- 121
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AN AMENDMENT TO
THE SERVICE AGREEMENT WITH THE WEST FORT COLLINS WATER DISTRICT
WHEREAS, on August 20, 1964, the City of Fort Collins entered into a
Service Agreement with the West Fort Collins Water District for the
treatment of water owned by the District and the delivery of the treated
water to the District's distribution system; and
WHEREAS, as provided in the Agreement, the City and the District can
mutually agree to increase the amount of water treated by the City; and
WHEREAS, the City and the District wish to increase the amount of
water treated to a maximum of 2.5 million gallons per day; and
WHEREAS, the City's relocation of Water Treatment Plant No. 1 will
result in the disconnection of service to current City customers and the
Amendment to the Agreement will provide water to these customers through
the District; and
WHEREAS, both the City and the District wish to extend the period of
time in which either party must give written notice of cancellation to this
other party from three (3) years to five (5) years; and
WHEREAS, the Board of the West Fort Collins Water District and the
Water Board of the City of Fort Collins have both reviewed and approved the
proposed amendments.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Agreement dated August 20, 1964 between the City of Fort
Collins and the West Fort Collins Water District be amended to make the
following changes to the Agreement:
1. The District agrees to serve City customers whose service will be
disconnected during the City's water treatment plant relocation Project.
2. The City agrees to treat additional water for the District. The
limit is changed from a maximum of 1200 taps to a maximum of 2.5 million
gallons per day.
3. The notice of cancellation period for the Agreement is changed
from three (3) to five (5) years.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 6th day of August, A.D. 1985.
