HomeMy WebLinkAbout1985-126-08/06/1985-AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS IN THE CITY (SHIELDS STRE • • RESOLUTION 85- 126 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS IN THE CITY WHEREAS, the City of Fort Collins desires to acquire certain lands hereinafter described for the purpose of the expansion and widening of South Shields Street in Fort Collins, and to also acquire such easements and rights-of-way as are necessary for the construction of related improvements, facilities and utilities; and WHEREAS, the City has previously attempted to negotiate the acquisition of said property, easements and rights-of-way from the owners thereof, with a final written offer having been submitted to said owners as required by law, which negotiations have been unsuccessful as of this date; and WHEREAS , the acquisition of said property , easements and rights-of-way is desirable and necessary for public use and said acquisition may be accomplished through proceedings in eminent domain. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. The City Council hereby finds and determines that it is necessary that the City of Fort Collins acquire certain lands, together with easements and rights-of-way, more particularly described as follows to be used as a roadway with related improvements, utilities and facilities; A twenty foot wide right of-way in that parcel described in Book 1386, Page 594 of the Larimer County records in the Southeast Quarter of Section 27, Township 7 North, Range 69 West of the 6th Principal Meridian, City of Fort Collins, Larimer County, Colorado being described as follows: Beginning at the Southeast corner of said Section 27 and considering the East line of the Southeast Quarter of said Section 27 to bear North 000 27' 27" west with all bearings contained herein relative thereto; thence Northerly along said East line North 00° 27 ' 27" west, 663.25 feet; thence departing said East line South 89' 48' 17" West, 30.00 feet to the existing Westerly right-of way line of South Shields Street and the True Point of Beginning of this description; thence departing said existing right-of-way line South 89° 48 ' 17" West 20.00 feet; thence North 00° 27 ' 27" West, 257.86 feet; thence North 89° 48' 17" East, 20.00 feet to said existing Westerly right-of-way line; thence Southerly along said existing right-of-way line South 00° 27' 27" East, 257.86 feet to the true point of beginning of this description. The above described right-of-way contains 5,160 square feet, more or less. Section 2. The City Council hereby finds and determines that it is not possible to acquire such property, easement and right-of-way by negotiating with the owners thereof and, accordingly, authorizes the City 0 Attorney and other proper officials of the City to acquire the same for the City by eminent domain proceeding.
