OF THE COUNCIL OF THE CITY OF FORT COLLINS
URGING VOTER SUPPORT FOR THE FUNDING OF THE LARIMER COUNTY JUSTICE
CENTER AND ENCOURAGING LARIMER COUNTY TO CONSIDER ALTERNATIVE
MEASURES TO BETTER MEET ITS LONG TERM CAPITAL NEEDS
WHEREAS, in November of 1996,Larimer County(the "County") sought voter approval
of a sales and use tax to fund the development of a new judicial law enforcement and public safety
facilities, which proposal was rejected by the voters; and
WHEREAS,the County has restructured the ballot question to be presented to the voters with
regard to this issue and has placed on the November 4, 1997 ballot two separate proposals which,
if approved by the voters would provide funding for the construction of a new county courthouse and
related parking facilities in Fort Collins; new courthouse facilities in Loveland; and the expansion
of the Latimer County Detention Center; and
WHEREAS,on October 1, 1996,the City Council adopted Resolution 96-121 expressing its
support for#ie ballot measure proposed by the County and identifying the various reasons why it
believed that the construction of the public safety facilities proposed by the County would be in the
best interests of the citizens of the City; and
WHEREAS, the City Council continues to believe that the passage of both of the Latimer
County ballot proposals is in the best interests of the residents of the City of Fort Collins for the
reasons stated in Resolution 96-121; and
WHEREAS,while recognizing that the proposed new County facilities are necessary to meet
a pressing public need,the City believes that the increasing need for such facilities is created largely
by the rapid and substantial growth in population that the County has experienced over recent years,
which growth is anticipated to continue and increase in the foreseeable future; and
WHEREAS,in order to better manage the impacts of such population increases and meet the
increasing demands for the expansion of public infrastructure facilities and services created by such
growth,the City believes that the County should have at its disposal a variety of growth management
mechanisms which will fairly allocate the costs of such growth among existing residents and new
developments; and
WHEREAS, in order to better meet these demands, the City strongly recommends that
Larimer County investigate new and creative ways of offsetting the impacts of growth within the
County, including,without limitation,the imposition of developer exactions and impact fees to help
funds the costs of the new infrastructure facilities and services necessitated by such growth and
development; and
WHEREAS,at present, Larimer County is a statutory county subject to specific legislative
constraints upon the methods by which it can deal with the impacts of growth and development;and

WHEREAS,under Article XIV, Section 16 of the Colorado Constitution and § 30-11-501,
g,=Q., C.R.S.,Larimer County is authorized to adopt a home rule charter which would enable the
County to avail itself of certain additional powers and functions as are authorized by statutes; and
WHEREAS, such additional powers may enable the County to better manage, and find
additional fiscal solutions for, the provisions of critical facilities and services necessitated by the
ongoing demands of growth and development within the County.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Fort Collins City Council supports and endorses the improvement
of public safety in Larimer County by the construction of new judicial facilities,the expansion of the
Larimer County Detention Center,and the construction of a Loveland courts building so as to better
serve the needs of current and future residents of the County.
Section 2. That the City Council hereby encourages the County to investigate new and
creative ways to meet the challenges presented by the growth and development in the County, in
order to more fairly apportion among existing residents and new development the cost of providing
the infrastructure facilities and services needed to offset the impacts of such growth and
development, which alternative measures might include, without limitation, the possibility of
becoming a home rule county under the relevant provisions of the Colorado Constitution and
statutes.
