OF THE COUNCIL OF THE CITY OF FORT COLLINS
GRANTING TO GIULIANO & FATHER
A PERMANENT AND A TEMPORARY GROUNDWATER
DRAINAGE EASEMENT THROUGH OVERLAND TRAIL PARK
WHEREAS, Giuliano & Father, as developer of Overland Farm Phase II,
has need to remove groundwater; and
WHEREAS, the need exists for the installation and maintenance of a
groundwater drainage line through Overland Trail Park in the City of Fort
Collins; and
WHEREAS, the Parks and Recreation Department of the City has agreed to
the granting of a temporary and a permanent easement; and
WHEREAS, an Easement Agreement has been prepared which sets out the
terms and conditions for the installation and maintenance by Giuliano &
Father of the groundwater drainage pipe through Overland Trail Park; and
WHEREAS, the terms and conditions of the agreement have been approved
and agreed upon by Giuliano & Father and all City Departments involved in
this project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a temporary and a permanent easement be granted to Giuliano &
Father for the installation and maintenance of a groundwater drainage line
located in the Overland Trail Park.
Passed and adopted at a regular meeting of the City Council held this
6th day of October, A.D. 1987.
