OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE CITY OF FORT COLLINS
POLICE OFFICERS' PENSION PLAN
WHEREAS, the City of Fort Collins hired Mercer-Meidinger-Hansen
Incorporated as consultant to prepare and file the forms necessary to
obtain a favorable determination letter from the Internal Revenue Service
for the City's Police Officers' Pension Plan; and
WHEREAS, the Internal Revenue Service issued a favorable determination
letter that is contingent upon the adoption of certain changes to the Plan;
and
WHEREAS, Mercer-Meidinger-Hansen Incorporated prepared an amendment
incorporating the required changes, and the Police Officers' Pension Board
and City staff have reviewed said amendment and recommended approval of the
same.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Police Officers' Pension Plan (as restated January 1,
1986) of the City of Fort Collins be amended effective January 1, 1986 by
adding thereto the following sections:
5.6 Commencement of Benefits: In any event, payment of benefits
shall commence not later than April 1 of the calendar year in
which the Participant attains age seventy and one-half (70 1/2) ,
or if later, the calendar year in which the Participant retires.
7.4 Commencement of Death Benefits: In no event shall Pension
payments, due to a spouse as a result of a Participant's death,
commence (or be paid) later than the date the deceased
Participant would have attained age seventy and one-half (70
1/2) . In no event shall Pension payments due a nonspouse
beneficiary commence (or be paid) later than one year after the
Participant's death.
Passed and adopted at a regular meeting of. the City Council held this
6th day of October, A.D. 1987.

hereby certify that attached hereto is a true and correct copy of
Resolution 87-138 amending the City of Fort Collins Police Officers'
Pension Plan (as restated January 1, 1986) , which was duly adopted by the
Council of the City of Fort Collins at a meeting duly held in accordance
with its bylaws on the 6th day of October, 1987.
I further certify that a quorum of the members of the Council of the
City of Fort Collins were present at said meeting and that said Resolution
has not been altered, modified, or rescinded and is not in full force and
effect.
