OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ESTABLISHMENT OF THE
NORTH FRONT RANGE TRANSPORTATION PLANNING
COUNCIL, AUTHORIZING THE CITY MANAGER
TO SIGN ARTICLES OF ASSOCIATION FOR
THIS COUNCIL, APPROVING THIS COUNCIL AS THE
METROPOLITAN PLANNING ORGANIZATION (MPO) FOR
THE URBANIZED AREAS OF GREELEY AND FORT COLLINS,
AND AUTHORIZING TRANSMITTAL OF A REQUEST TO
THE HONORABLE ROY ROMER, GOVERNOR OF THE
STATE OF COLORADO, TO DESIGNATE THE NORTH FRONT
RANGE TRANSPORTATION PLANNING COUNCIL AS THE MPO
WHEREAS, the City of Fort Collins desires to work together with other
local governments in Larimer and Weld Counties to develop transportation
plans and policies that will assist in managing projected growth in a
sound, cost-effective manner; and
WHEREAS, the City of Fort Collins has determined that the best way to
achieve the above objective is to join together with other local
governments in a North Front Range Transportation Planning Council (the
Planning Council ) ; and
WHEREAS, such right of local governments to join together for common
purposes is ensured under Article XIV, Section 18(2) of the Colorado
Constitution and under Part 2 of Article 1 of Title 29, C.R.S. , as amended;
and
WHEREAS, the designation of a Metropolitan Planning Organization (MPO)
is required under Section 134 of Title 23, U.S.C. , as amended, for the use
of Federal funds in transportation projects within U.S. Census designated
urbanized areas; and
WHEREAS, the Fort Collins area, composed of the City of Fort Collins
and portions of unincorporated Larimer County, was designated as urbanized
by the U.S. Census following the 1980 Census; and
WHEREAS, Section 174 of the Clean Air Act, as amended, requires that,
for areas which have not attained national standards for carbon monoxide
and other designated pollutants, the State and officials of local
government shall jointly determine an implementation plan to bring the area
into compliance; and
WHEREAS, Section 174 of the Clean Air Act further requires that an
organization of local elected officials, hereinafter referred to as the
Lead Planning Agency (LPA) , shall be designated under an agreement between
the State and local governments to prepare such an implementation plan; and
WHEREAS, Section 174 of the Clean Air Act stipulates that, where
feasible, such an organization shall be the MPO designated to conduct the
transportation planning process for the area under Section 134 of Title 23,
U.S.C. ; and
WHEREAS, the Fort Collins urban areas have not attained national
standards for carbon monoxide; and
WHEREAS, the City of Fort Collins has determined that the Planning
Council is the most appropriate entity to be designated as the MPO and the
LPA for the urbanized area.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. That the City of Fort Collins approves the Articles of
Association for the Planning Council and authorizes the City Manager to
sign said Articles and become a member of the Planning Council .
Section 2. That the City of Fort Collins approves the Planning
Council as the MPO for the urbanized area, including this jurisdiction, and
authorizes the City Manager to transmit a request to the Governor of
Colorado to designate the Planning Council as the MPO.
Section 3. That the City of Fort Collins approves the Planning
Council as the LPA for the non- attainment area , including this
jurisdiction, and authorizes the City Manager to transmit a request to the
Governor of Colorado to designate the Planning Council as the LPA.
Section 4. That the Planning Council shall be empowered to draft
Memorandums of Agreement between the State of Colorado and the Planning
Council which establish the Planning Council as the MPO and the LPA for the
Fort Collins and Greeley areas, and to enter into such Memorandums of
Agreement with the State.
Section 5. That the City of Fort Collins shall continue to consider
other options available to it for air quality planning.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 1st day of September, A.D. 1987.
