OF THE COUNCIL OF THE CITY OF FORT COLLINS
RESCINDING ORDINANCE NO. 40, 1985,
RESOLUTION NO. 85-47 AND RESOLUTION NO. 85-48
RELATING TO THE CREATION OF THE ROSSBOROUGH SPECIAL
IMPROVEMENT DISTRICT NO. 85 TO THE CITY OF FORT
COLLINS, COLORADO, AND PROVIDING FOR THE
CONSTRUCTION OF IMPROVEMENTS THEREIN
WHEREAS, the Council (the "Council ") of the City of Fort Collins,
Colorado (the "City") on April 2, 1935 approved Resolution No. 85-47
of the City, accepting the Petitions of property owners (the
"Petitioners") regarding the initiation of a special improvement
district and describing the area to be assessed for improvements to be
made as a part of such district; and
WHEREAS, on April 2, 1985, the Council approved Resolution No.
85-48 of the City adopting the report of the Director of Public Works
which report describes the nature of the improvements to be installed
as a part of the Rossborough Special Improvement District No. 85 to
the City (the "District") ; and
WHEREAS, on April. 16, 1985, Council approved on second reading
Ordinance No. 40, 1985 creating and organizing the District and
providing for the construction of improvements within specified
boundaries of said District; and
WHEREAS, on April 30, 1985, Ordinance No. 40, 1985 creating and
organizing the District was recorded with the Larimer County Clerk and
Recorder at Reception No. 85020253 in order to provide public notice
of assessments contemplated to be levied against properties in the
District in connection with the installation of District improvements;
and
WHEREAS, subsequent to the creation and organization of the
District, the City and Petitioners jointly determined not to proceed
with the issuance of municipal bonds for the payment of District
improvements; and
WHEREAS, as a result of the decision not to issue District bonds
to finance the improvements, no District improvements have been or
will be installed, and, no assessments will be levied upon property in
the District; and
WHEREAS, Section 16-9 of the City Code authorizes the rescission
by resolution of all District proceedings at any time prior to the
installation of improvements; and
WHEREAS, the Council of the City is of the opinion that it is in
the best interests of all concerned parties to rescind all proceedings
heretofore initiated relative to the Rossborough Special Improvement
District No. 85 to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, COLORADO that pursuant to Section 16-9 of the City Code, the
Council hereby rescinds all proceedings pertaining to the Rossborough
Special Improvement District 85, as described in Resolutions 85-47 and
85-48 and Ordinance No. 40, 1985, of the City of Fort Collins.
Passed and adopted at a regular meeting of the Council of the
City of Fort Collins held this 20th day of January, 1987.
