OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING THE
PETITIONS OF PROPERTY OWNERS REGARDING THE INITIATION OF A SPECIAL
IMPROVEMENT DISTRICT , STATING THE NEED FOR , THE NATURE OF, AND THE
LOCATION OF THE IMPROVEMENTS TO BE MADE , DESCRIBING THE AREA TO BE
ASSESSED FOR THE SAME , AND DIRECTING THE DIRECTOR OF PUBLIC WORKS
TO PREPARE AND PRESENT TO THE CITY COUNCIL THE NECESSARY INFORMA-
TION FOR THE FORMATION OF SAID DISTRICT .
WHEREAS , the Council of the City of Fort Collins , Colorado
( the " Council " ) , has received Petitions from affected property
owners in the area (the "Petitioners" ) of the proposed South Lemay
Special Improvement District No . 86 (the " District" ) requesting
that said Council initiate proceedings for the creation of the
District for the purpose of acquiring , constructing, and
installing street , street lighting , water , sanitary sewer , bridge ,
and storm drainage improvements in the City of Fort Collins ,
Colorado (the "City" ) ; and
WHEREAS, the Council has received the Petitions , accepts the
same , and desires to proceed with the formation of the District .
NOW , THEREFORE , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS:
Section 1 . That the Petitions , as submitted by the
Petitioners requesting the formation of the District , are hereby
received and accepted .
Section 2 . That the improvements to be constructed will
consist generally of street , curbs , gutter, and sidewalk , street
lighting , landscaped medians and streetscapes , water, sanitary
sewer, bridge and storm drainage improvements . Such improvements
are needed in order to provide adequate access for vehicles and
pedestrians to the properties abutting the street to be improved ,
and in order to provide water and sewer utility service and
adequate storm drainage to properties within the District .
Section 3 . That it is hereby recognized that the street ,
street lighting , water, sanitary sewer , bridge , and storm drainage
improvements as hereinafter designated , will confer special
benefits on the real property in the District and general benefits
to the City at 1arge .
Section 4 . That the nature and location of the improvements
to be made in the District are as set forth on Exhibit " A"
attached hereto and by this reference incorporated herein .
Section 5 . That the Director of Public Works is hereby
directed to prepare and present to the Council the following :
a . Preliminary plans and specifications of the
improvements described herein ; and
b . An estimate of the probable total cost of such
improvements , including the cost of planning , constructing , or
otherwise acquiring the same ; engineering , legal and advertising
costs ; interest during construction and until assessments are made
by ordinance against the properties benefited , and other inci -
dental costs incurred in the District ; and
C . A map of the District to be assessed for the cost
of improvements .
Section 6 . That the area to be assessed for the District
improvements described on Exhibit "A" hereto shall be as set forth
in the Petitions heretofore submitted by Petitioners and on file
with the City Clerk .
Section 7 . That the District shall be known as the South
Lemay Special Improvement District No . 86 .
Passed and adopted at a regular meeting of the City Council
held this 21st day of January 1986 .

EXHIBIT "A"
DISTRICT IMPROVEMENTS
A . Streets
Generally, street improvements in the district will consist
of major improvements to South Lemay Avenue from Windsor Road to
Fossil Creek , including asphalt and base course , and in some areas
curb , gutter , and landscaped median islands as follows :
South Lemay Avenue :
( 1 ) From its intersection with Windsor Road north
a distance of approximately 2 , 699 lineal feet , on the west half
only of the street , to a width of 30 feet from flow line to
pavement edge including curb , gutter, and sidewalk on the west
side of the street .
( 2 ) From its intersection with Trilby Road south a
distance of approximately 2 , 585 lineal feet to a width of 72 feet
from flow line to flow line .
( 3 ) From its intersection with Trilby Road north a
distance of approximately 4 , 549 lineal feet on the west half of
the street only to a width of 30 feet from flow line to pavement
edge including curb , gutter , and sidewalk on the west side of the
street .
(4) Landscaped median islands at various points
along the entire length of the street .
B . Storm Drainage
( 1 ) A five-barrel concrete box culvert under Lemay
Avenue located adjacent to property in the district owned by MSP
Investment Company.
( 2 ) The construction of miscellaneous drainage
structures and appurtenances , including minor storm sewer systems ,
channels and various culverts , at various points crossing and
under South Lemay Avenue .
( 3) The construction of a bridge and appurtenances
over Fossil Creek at the point at which Fossil Creek intersects
South Lemay Avenue .
C . Water
Water improvements will consist of approximately 9 , 834
feet of a 20- inch water main under Lemay Avenue, north from its
intersection with Windsor Road and including necessary appurte-
nances thereto .
D . Sanitary Sewer
The sanitary sewer improvements will consist generally
of sanitary sewer mains , manholes , and plugs and will be located
as follows :
( 1 ) A 10-inch ssnitary sewer main under South
Lemay Avenue from its intersection with Windsor Road , north a
distance of approximately 1 ,447 lineal feet .
( 2 ) A 10- inch sanitary sewer main under Windsor
Road from its intersection with South Lemay Avenue west
approximately 281 lineal feet to an existing South Fort Collins
Sanitation District sewer line .
( 3 ) An 8- inch sanitary sewer main under South
Lemay Avenue from approximately 1 , 107 lineal feet north of its
intersection with Windsor Road northward a distance of
approximately 340 lineal feet .
