OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN
PROCEEDINGS OF CERTAIN LANDS FOR ROAD IMPROVEMENTS
WHEREAS, the City of Fort Collins desires to acquire certain property
hereinafter described for the purpose of the widening of County Road 52
immediately north of the Anheuser-Busch brewery site; and
WHEREAS, the City has previously attempted to negotiate the
acquisition of said property from the owner thereof, which negotiations
have been unsuccessful ; and
WHEREAS, the acquisition of the same is desirable and necessary for
public use and said acquisition may, by law, be accomplished through
proceedings in eminent domain.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1 . The City hereby finds and determines that it is necessary
that the City of Fort Collins acquire certain property described as follows
to be used as a roadway with related improvements and facilities:
LEGAL DESCRIPTION
A parcel of land situated in the Southwest one-quarter of Section 28,
Township 8 North, Range 68 West of the Sixth Principal Meridian, City
of Fort Collins, County of Larimer, State of Colorado, more
particularly described as follows:
Commencing at the Southeast corner of said Section 28, thence N89°
53'01"W along the south line of said Section 28 a distance of 848.52
feet; thence N0000659"E a distance of 25.00 feet to the northerly
right-of-way of County Road 52, said point also being the Point of
Beginning; thence N89°53'01"W along said right-of-way and parallel to
the South line of said Section 28 a distance of 1779. 13 feet to a
point on the easterly line of the Burlington Northern Railroad
right-of-way described in Book 2291 on Page 1062 Larimer County
Records; thence N00°20'23"W along said right-of-way a distance of
25.00 feet; thence departing said right-of-way S89°53'01"E a distance
of 724.48 feet; thence S87°31'33"E a distance of 170. 14 feet;thence
S89°22'18"E a distance of 307.81 feet; thence N84°30'33"E a distance
of 63.29 feet; thence N00°06'59"E a distance of 8.00 feet; thence N880
52'15"E a distance of 92.02 feet; thence SSO'16'25"E a distance of
169.06 feet to a point on the northerly right-of-way line of
Interstate Highway 25 recorded in Book 1276 on Page 254 Larimer County
Records; thence S83°06'58"W along said right-of-way a distance of
80.22 feet more or less to the Point of Beginning. The above parcel
containing 42,521 .75 square feet or 0.976 acres more or less.
Section 2. The City Council hereby finds and determines that it is
not possible to acquire such property by negotiating with the owner thereof
and, therefore, authorizes the City Attorney and other proper officials of
the City to acquire the same for the City by eminent domain proceedings.
Passed and adopted at a regular meeting of the City Council held this
20th day of May, A.D. 1986
