HomeMy WebLinkAbout1986-086-05/20/1986-APPROVING WAIVER OF ONE-SIXTH CONTIGUITY AND PUBLIC SEWER REQUIREMENTS FOR DEVELOPMENT IN THE URBAN RESOLUTION 86- 86 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING WAIVER OF THE ONE-SIXTH CONTIGUITY AND PUBLIC SEWER REQUIREMENTS FOR DEVELOPMENT IN THE URBAN GROWTH AREA (KNOWN AS DRY CREEK STORAGE PUD) WHEREAS, the Urban Growth Agreement provides that in order for sites in Larimer County to develop within the Urban Growth Area and outside the city limits of Fort Collins certain phasing criteria need to be met; and WHEREAS, the Larimer County Commissioners may waive phasing criteria for development in the Urban Growth Area provided that: 1. Such requested waiver is approved by the governing body of the adjoining municipality after said body has substantiated the required findings. 2. The waiver will not result in unplanned expense for provision of public services, improvements or facilities. 3. The waiver is consistent with the intent and purpose of the City's and County's Comprehensive Plans and Policies. 4. The waiver application contains material indicating approval may be granted without substantial detriment to the intent of the Supplementary Regulations applying to the area. 5. The waiver application contains material indicating there are exceptional circumstances applying to the specific piece of property that do not generally apply to the remaining property in the UGA. 6. The waiver application contains material indicating approval would not impair the public health and safety by creating undesirable traffic or sanitary conditions or adverse environmental influences in the area. and WHEREAS, the developer of Dry Creek Storage PUD requests a waiver of two phasing criteria, namely, the one-sixth contiguity requirement and the public sewer requirement; and WHEREAS, the intent of the waiver process is to give priority to in-fill development; and WHEREAS, the nature of the developments around the Dry Creek Storage PUD make the proposed property essentially an in-fill parcel ; and WHEREAS, for this reason City staff believes the contiguity waiver request does meet the intent of the waiver process; and WHEREAS, only a small (24' x 70') office/residence is proposed on this site, which the County Health Department feels would be adequately served by a septic system rather than requiring connection to the nearest City sewer line, which is approximately one-half mile from the site; and WHEREAS, City staff believe the public sewer waiver request is reasonable for this particular use if this waiver will be reevaluated in case of expansions of use or with any other future use; and WHEREAS, the Dry Creek Storage PUD waiver requests meet the criteria set forth above for waivers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Dry Creek Storage PUD one-sixth contiguity waiver and public sewer waiver be, and the same hereby are, approved on condition that the public sewer waiver request be reevaluated in case of expansions of use or with any other future use proposed at the site.
