OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE AWARD OF A CONTRACT TO OTHER THAN
THE LOW BIDDER FOR FIBERGLASS VAULTS AND ACCESSORIES
FROM MESA FIBERGLASS PRODUCTS
WHEREAS, in 1972 the City of Fort Collins and City employee, Robert
Kost, entered into an agreement with Mesa Fiberglass Products for the
manufacture and supply of fiberglass vaults invented by Mr. Kost and used
by the City's Light 6 Power Department; and
WHEREAS, this year the City Purchasing Department was able to issue a
Request for Bid (3310) to solicit manufacturers for this vault system; and
WHEREAS, the lead times necessary to evaluate a new vendor's
capabilities and the time required to set up and manufacture the vault
system were longer than anticipated; and
WHEREAS, the low bidder, Wood Manufacturing Co. , Inc. has not been
fully evaluated and would not be able to supply the City with the number of
fiberglass vault systems needed before the City's present supply is
exhausted; and
WHEREAS, Section 2-58(G) of the Code of the City of Fort Collins
provides for the award of any bid to other than the low bidder when the low
bidder cannot perform as specified and cannot meet the time frame for
performance; and
WHEREAS, Mesa Fiberglass Products is the next lowest bidder and can
produce and deliver to the City the vault systems needed within the desired
time; and
WHEREAS, the cost of these systems purchased from Mesa Fiberglass
Products will not exceed Seventy-Nine Thousand One Hundred and Thirty
Dollars ($79,130.) ; and
WHEREAS, pursuant to Section 2-58 of the Code of the City of Fort
Collins, no award shall be made to other than the low bidder in excess of
Twenty Thousand Dollars ($20,000.) until approved by the City Council in an
open Council meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Purchasing Agent be, and he hereby is, authorized to make
an award to Mesa Fiberglass Products for the manufacture and delivery of
fiber glass vault systems for a cost not to exceed Seventy-Nine Thousand
One Hundred and Thirty Dollars ($79,130.) .
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 3rd day of June, A.D. 1986.
