OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING THE
PETITIONS OF THE PROPERTY OWNERS REGARDING THE INITIATION OF THE
ARBOR PLAZA SPECIAL IMPROVEMENT DISTRICT, STATING THE NEED FOR,
THE NATURE OF, AND THE LOCATION OF THE IMPROVEMENTS TO BE MADE,
DESCRIBING THE AREA TO BE ASSESSED FOR THE SAME, DIRECTING THE
DIRECTOR OF PUBLIC WORKS TO PREPARE AND PRESENT TO THE CITY
COUNCIL THE NECESSARY INFORMATION FOR THE FORMATION OF SAID
DISTRICT AND REPEALING RESOLUTION 86-20.
WHEREAS, the Council of the City of Fort Collins,
Colorado (the "Council" ) , has received the Petitions from Kroh
Brothers Development Company, a Missouri corporation ( "Kroh" ) and
Kensington Ltd. , a Colorado limited partnership ( "Kensington" ) ,
the property owners of the area (collectively the "Petitioners" )
of the proposed ARBOR PLAZA SPECIAL IMPROVEMENT DISTRICT (the
"District" ) , requesting that Council initiate proceedings for the
creation of a special improvement district for the purpose of
acquiring, constructing, and installing street, water, sanitary
sewer, and minor storm drainage improvements in the City of Fort
Collins, Colorado (the "City" ) ;
WHEREAS, the Council has received the Petitions, accepts
the same, and desires to proceed with the formation of the
District; and
WHEREAS, the Council has previously adopted Resolution
86-20 which it now desires to repeal and replace with this
Resolution due to changes in the improvements to be constructed
and the property to be included within the District.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF FORT COLLINS:
Section 1. That the Petitions as submitted by Petitioners
requesting the formation of the District are hereby received and
accepted.
Section 2. That the improvements to be constructed con-
sist generally of street improvements ( including curb, gutter,
sidewalk, asphalt, base course and grading) , water distribution
system, sanitary sewer system, and minor storm drainage system
improvements. Such improvements are needed in order to provide
adequate access for vehicles and pedestrians to the properties
abutting the streets to be improved, and in order to provide
adequate utility service to properties within the District.
Section 3. That it is recognized that the street, water,
sewer, and minor storm drainage improvements as hereinafter
designated, will confer special benefits on the real property in
the District and general benefits to the City at large.
Section 4. That the nature and location of the improve-
ments to be made in the District are generally as follows:
A. Streets
Street improvements, including curb, gutter,
sidewalk, asphalt, base course and grading, traffic signals,
landscaping, and utility relocation will be made for Mason
Street, Harmony Road, South College Avenue and Kensington
Drive. The Mason Street improvements commence approximately 550
feet north of Harmony Road and extend southerly approximately
1470 feet to an intersection with South College Avenue. The
Harmony Road improvements extend east of the center line of South

College Avenue approximately 520 feet and west of the center line
of South College avenue approximately 1150 feet. The South
College Avenue improvements commence at the flow line
intersection of the southwest corner of Harmony Road and South
College Avenue and extend south approximately 750 feet along the
west side of South College Avenue. The Kensington Drive
improvements commence at the west side of South College Avenue
and extend west approximately 490 feet to the east side of Mason
Street.
B. Water
The water distribution system will provide
8-inch lines which generally run through the site in two loca-
tions connecting to the existing Harmony Road main to the north
of the site and the existing South College Avenue main to the
east of the site. The improvements will also include a 6-inch
water line within the Kensington Drive right-of-way.
C. Sanitary Sewer
Sanitary sewer will be a system of 8-inch
mains and appurtenances flowing to an existing 8-inch outfall
main south of the District.
D. Storm Drainage
Storm drainage will consist of a series of
reinforced concrete storm sewer mains, catch basins, and release
structures and the portion of an 8 foot by 6 foot box culvert
located under the Mason Street right-of-way to carry the 100-year
design flows of Mail Creek and the New Mercer Canal which
currently traverses the site in an open channel.

Section 5. That the Director of Public Works is directed
to prepare and present to the Council the following:
a. Preliminary plans and specifications of the
improvements proposed.
b. An estimate of the total cost of such improve-
ments, including the cost of planning, acquiring and constructing
the same, engineering, legal and advertising costs, interest
during construction and until assessments are made by ordinance
against the properties benefited, and other incidental costs.
C. A map of the District to be assessed for the
cost of improvements.
Section 6. That the area to be assessed for the improve-
ments described in Section 4 shall be as set forth in the
Petitions heretofore submitted by Petitioners.
Section 7. That said improvement District shall be known
as the Arbor Plaza Special Improvement District No. 88.
Section 8. Resolution 86-20 of the Council of the City of
Fort Collins is hereby repealed.
Passed and adopted at a regular meeting of the City
Council held this 1st day of July , 1986.
