HomeMy WebLinkAbout1985-138-09/03/1985-REGARDING RAILROAD GRADE CROSSING PROTECTION IN THE NORTHEAST SECTOR OF THE CITY AND COMMITMENT, WHE RESOLUTION 85- 138 OF THE COUNCIL OF THE CITY OF FORT COLLINS REGARDING RAILROAD GRADE CROSSING PROTECTION IN THE NORTHEAST SECTOR OF THE CITY AND COMMITMENT, WHEN ECONOMIC GROWTH REQUIRES, TO A GRADE SEPARATION WHEREAS, City seeks to foster growth consistent with its current high quality of life; and WHEREAS, City is primarily experiencing economic growth and development along its southern lines; and WHEREAS, City has developed a plan within its Land Development Guidance System to encourage development to the north of the City and to continue to ensure the City's overall high quality of life; and WHEREAS, to further encourage growth and development along the City's northerly lines, the City is among other things proposing to widen and reconstruct Larimer County Road 50 between Interstate 25 and County Road 9; and WHEREAS, the pending development of a brewery and other anticipated growth in the vicinity of said crossing is expected to result in an increase in vehicular traffic by the year 1990 to four thousand one hundred and ninety-five (4,195) vehicles per day; and WHEREAS, by 1990 the train movements across said County Road 50 are expected to increase from the present six (6) *rains per day to seven (7) trains per day plus two (2) switching movements per day; and WHEREAS, according to the present formulas of the Public Utilities Commission, the combination of train and vehicular traffic at said crossing would not, currently or during the next ten (10) years, suggest a grade separation at said crossing; and WHEREAS, said growth and development of areas adjoining the above-described portion of County Road 50, and the development of other areas which may impact said crossing, may at some future time cause the at grade crossing now planned for said County Road 50 and the Burlington Northern Railroad crossing to become increasingly hazardous to vehicular traffic thereover and thereby negatively affect the City's quality of life, and the health, safety and welfare of the City's citizens; and WHEREAS, the City wishes to establish a protective mechanism to assure to the extent possible that unreasonably hazardous conditions on its streets and roads are avoided. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that: 1. An "at grade" crossing, with flashing lights, gates and a raised median, best protects the health, safety and welfare of the citizens of the City presently, and in the reasonably foreseeable future. 2. The City shall establish annual monitoring of vehicular traffic along County Road 50 at the said railroad grade crossing. 3. The City shall require each proposed major development along County Road 50 and in the vicinity to provide traffic projections at the said crossing. 4. In the event the traffic monitored and projected, and the number of daily trains using the crossing represent a hazard to the public or a projected exposure to hazards, the City, then will exercise its best effort in coordination with other applicable regulatory agencies to proceed with the installation of a grade separation or other improvements as may be technologically available to ensure an equivalent level of safety at said crossing. 5. The City may take such other actions as are necessary to ensure to the Public Utilities Commission that the aforesaid crossing shall continue to afford an adequate level of safety, such actions to include, without limitation, any efforts that the City may legally exert and deem reasonable and necessary to minimize conflicts at the said crossing, including, within the City's legal limitations, limitations on growth, development and expansion of surrounding areas, including lands owned by Anheuser-Busch Companies, its heirs, successors and assigns. 6. In furtherance of the foregoing, Anheuser-Busch Companies, Inc. has agreed in writing to provide for a mechanism to ensure that Anheuser-Busch and future owners of Anheuser-Busch property contribute their proportionate share of the cost of such grade separation, or any equivalent safety devices.
