RESOLUTION 85- 29
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE OPTIONING OF LAND TO ANHEUSER-BUSCH
AND THE TRANSFER PURSUANT TO SAID OPTION;
AND FURTHER AUTHORIZING THE CONVEYANCE OF CERTAIN
EASEMENTS TO ANHEUSER-BUSCH
WHEREAS, Anheuser-Busch has, pursuant to its master agreement with the
City of Fort Collins, requested easements for its process waste water line,
which easements are to be located across a portion of Roselawn Cemetary and
across a portion of the "Riverbend" ponds, the location of which easements
are more particularly described on Exhibits III & IV, attached hereto; and
WHEREAS, Anheuser-Busch has further requested that the City enter into
an Option Agreement with respect to approximately 4.6 acres of land located
adjacent to Wastewater Treatment Plant #2 for the potential location of its
treatment plant, which land is more particularly described on Exhibit V,
attached hereto; and
WHEREAS, in the event that Anheuser-Busch should elect to exercise
said option, the purchase price of said lands shall be the appraised value
of the lands at the time of the exercise of the option, which value is
presently established as $25,000, but is subject to change, depending upon
the time of exercise of said option; and
WHEREAS, the Council of the City of Fort Collins does hereby determine
that the aforesaid property is not used or intended to be used for munici-
pal purposes, nor secured for the purpose of being used for municipal
purposes, and that it is for the best interests of the City of Fort Collins
that the above described interests in real property be sold and conveyed to
Anheuser-Busch.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the Mayor and the City Clerk be, and they hereby are, author-
ized to execute such good and sufficient Option Agreements and Deeds of
Conveyance as may be necessary to effectuate the aforesaid transfers of
interests in real property, including such Deeds of Conveyance as may be
necessary to effectuate the transfer of property in the event that Anheuser
Busch should elect to exercise its option as aforesaid.
Passed and adopted at a regular meeting of the City Council held this
19th day of February, A.D. 1985.
