OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE INTERGOVERNMENTAL AGREEMENT WITH
LARIMER COUNTY PERTAINING TO
OWNERSHIP AND OPERATION OF THE SANITARY LANDFILL
WHEREAS, the City of Fort Collins ("City") and Larimer County ("Coun-
ty") , and the City of Loveland, did, on the 21st day of November, 1974,
enter into an Agreement pertaining to the ownership and operation of the
sanitary landfill in Larimer County (the Agreement) ; and
WHEREAS, pursuant to paragraph 10 of said Agreement , the landfill site
shall continue to be used as the site of a landfill open to the public and
any other use of the site shall be reviewed and approved by the City, the
County, and the City of Loveland ; and
WHEREAS, the County has requested the approval of the City for the
operation of a shooting range at the landfill site as said range is
described in the "Larimer County Rezoning and Special Review Request
#56-84, County Referral ", which referral was reviewed and approved by the
City Planning and Zoning Board at its February 25, 1985 meeting ; and
WHEREAS, the Council has determined that it is in the best interests
of the City that consent be given for the installation of said shooting
range upon condition that the County indemnify and hold harmless the City
from all liability that might arise as a result of activities upon said
shooting range.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City enter into an Amendment Agreement with Larimer County
for the purpose of modification of the Agreement to permit the installa-
tion, operation and maintenance, by the County, of a shooting range as
above described, upon condition that the County indemnify and hold harmless
the City from any and all liability that might arise as a result of damages
or injuries to persons or property out of the activities upon said shooting
range, and defend the City against any such claims or actions that may be
commenced against the City as a result of said damages or injuries .
Passed and adopted at a regular meeting of the Council of the City
of Fort Collins held this 19th day of March, A.D. 1985.
