OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY ATTORNEY TO INTERVENE AND
FILE A PROTEST WITH THE COLORADO PUBLIC UTILITIES COMMISSION
PERTAINING TO THE APPLICATION OF TRAILWAYS LINES, INC.
TO ABANDON THE TRANSPORTATION OF PASSENGERS
ON SCHEDULE BETWEEN A MAJORITY OF POINTS IN
THE STATE OF COLORADO
WHEREAS, pursuant to Application No. 37864 before the Public Utilities
Commission of the State of Colorado, Trailways Lines, Inc. , has requested
authorization to abandon all scheduled operations under certificates of
public convenience and necessity authorizing the transportation of
passengers on schedule between a majority of points in the State of
Colorado; and
WHEREAS, the City of Fort Collins is one of the points authorized for
the transportation of passengers; and
WHEREAS, pursuant to law, Trailways Lines, Inc. , is a public utility
declared by law to be affected with a public interest which utility cannot
operate in the State of Colorado without having first obtained from the
Public Utilities Commission a certificate declaring that the present or
future public convenience and necessity requires or will require such
operation; and
WHEREAS, Trailways Lines, Inc. has, as a result of its having obtained
certificates of public convenience and necessity, may substantially benefit
from its status as a regulated monopoly and should be required to continue
the provision of services to the citizens of the State of Colorado, and,
particularly, the City of Fort Collins, Colorado.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Attorney be, and he hereby is, authorized to file,
with the Public Utilities Commission of the State of Colorado, such
documents as are necessary to intervene in and protest the application of
Trailways Lines, Inc. , No. 37864 to abandon all scheduled operations under
certificates of public convenience authorizing the transportation of
passengers on schedule between a majority of points in the State of
Colorado.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 7th day of October, A.D. 1986.
