HomeMy WebLinkAbout1998-018-01/20/1998-APPROVING EXPECDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE WATER UTILITY FUND FOR T RESOLUTION 98-18 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE WATER UTILITY FUND FOR THE COMMISSION OF A METAL SCULPTURE TO BE PLACED IN THE XERISCAPE GARDEN AT CITY HALL WHEREAS, Section 23-303 of the City Code, established the Art in Public Places Reserve Account for use in the acquisition or leasing of works of art,maintenance,repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by Council in Ordinance No. 20, 1995 (the "Guidelines"); and WHEREAS,the Water Utility has completed a number of projects,primarily underground water lines and related improvements (the"Projects"),that do not offer appropriate sites for Art in Public Places projects; and WHEREAS, one percent (1%) of the funds from the Projects has been set aside in the Art in Public Places Reserve Account in the Water Utility Fund for public art,and the Water Utility has instead proposed the use of such funds for public art in connection with the Xeriscape Garden project at City Hall (the "Xeriscape Garden"); and WHEREAS,the Art in Public Places Board(the `Board") evaluated proposed works of art for the Xeriscape Garden in a competitive proposal process based on the Guidelines; and WHEREAS,based on that evaluation,the Board selected the proposal of artist Don Mitchell to create a colorful metal sculpture approximately five feet tall,and including twelve stylized flower forms, at its December 16, 1997 meeting; and WHEREAS, the estimated cost to create the proposed metal sculpture, including administration, commission of the artists, contingency and maintenance of the pieces is Twenty Thousand Dollars ($20,000); and WHEREAS, adequate funds are available and were previously appropriated in the Art in Public Places Reserve Account in the Water Utility Fund in 1997 to provide for the commission of Don Mitchell to create a flower inspired metal sculpture for the Xeriscape Garden, but were not spent or encumbered; and WHEREAS, staff will present to the Council as part of the Reappropriation Ordinance in February, 1998,the reappropriation in the 1998 budget year of the funds that were appropriated for this project in 1997; and WHEREAS,the Guidelines require that the Council approve the Board's selection of public art. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the expenditure of up to Twenty Thousand Dollars($20,000) from the Art in Public Places Reserve Account in the Water Utility Fund, for the metal sculpture proposed by artist Don Mitchell, the conceptual design of which was selected and approved by the Art in Public Places Board on December 16, 1997, is hereby authorized, contingent upon the reappropriation of funds previously appropriated unencumbered for this project in 1997.
