OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE HUMAN RELATIONS COMMISSION TO REVIEW THE
OLD TOWN SQUARE INTERNAL INVESTIGATION DOCUMENTS
WHEREAS, the Council of the City of Fort Collins has created a Human
Relations Commission pursuant to Section 2-261 of the Code of the City of Fort
Collins ("Code") ; and
WHEREAS, there exists a Police Subcommittee of the Human Relations
Commission which provides education concerning Police Services and its
relationship with the community and which also conducts reviews of certain
internal investigations conducted by Police Services; and
WHEREAS, pursuant to Police Services Policy #4, the Police Subcommittee
may, upon request of a complainant, conduct a review of the documents compiled
in an internal investigation, for the purposes of addressing any concerns of the
complainant about the accuracy or sufficiency of the investigation; and
WHEREAS, Police Services has concluded an internal investigation into an
incident which occurred on July 4, 1991, in the area of Old Town Square, Fort
Collins, Colorado; and
WHEREAS, Chief Fred Rainguet desires to submit the internal investigation
documents to the Police Subcommittee for a review to determine: (1) whether any
concerns might exist about the accuracy or sufficiency of the investigation and
(2) whether the Human Relations Commission has any recommendations about the
handling of similar incidents in the future; and
WHEREAS, Police Services is willing to provide funds to enable the Police
Subcommittee to utilize the services of an independent consultant with expertise
in the area of use of force, if requested by the Subcommittee; and
WHEREAS, pursuant to Section 2-263(5) of the Code, the Council may
authorize the Human Relations Commission to perform such functions as are
committed to it by ordinance or resolution; and
WHEREAS, this authorization by Council for review of the internal
investigation documents will not result in a public dissemination of the contents
or the internal investigation file; and
WHEREAS, the names of the police officers involved in the incident will
be replaced with representative numbers and the revised contents of the internal
investigation will not constitute personnel files within the meaning of the
Public Records Act, Title 24, Article 72, C.R.S. ; and
WHEREAS, the next meeting of Human Relations Commission is scheduled for
Thursday, November 14, 1991 .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
1. That the Human Relations Commission is hereby authorized to accept

the internal investigation documents concerning the incident which
occurred on July 4, 1991, in the area of Old Town Square, Fort
Collins, Colorado and refer them to its Police Subcommittee for
review.
2. That the review of the Police Subcommittee shall be directed to
determine: (1) whether the internal investigation, as completed,
raises any concerns about its sufficiency and/or accuracy and (2)
whether the Human Relations Commission has any recommendations about
the handling of similar incidents in the future.
3. That upon completion of its review, the Police Subcommittee shall
submit any concerns and/or recommendations it may have for addressing
those concerns to Chief Rainguet and the City Manager.
4. That the period for conducting the review and submitting
recommendations to Chief Rainguet shall not exceed ninety (90) days
from the date of this Resolution.
5. That all matters related to this review shall be kept in the
strictest confidence by members of the Human Relations Commission.
To this end, all members involved shall take those measures necessary
to ensure the integrity of the documents, the confidentiality of the
subject matter contained therein and the confidentiality of any
discussions held, concerns identified and recommendations made.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 12th day of November, A.D. 1991 .
